Prospect Industrial Park with the Side Hill Project Development Plan. The
frontage along the Drake Reclamation Plant property is 451 feet.
The plat indicates proper dedication for utility easements as needed to serve
both lots. In particular, the plat dedicates a 100-foot wide drainage easement for
the benefit of Prospect East Industrial Park for a stormwater outfall into an
existing pond.
In general, the replat preserves existing utilities and easements and grants and
dedicates additional right-of-way and easements in such a way as to enhance an
interconnected street system within and between neighborhoods, preserves
natural areas and features, and otherwise accomplishes the purposes and intent
of the Land Use Code.
C. Section 3.3.1(C)(1) — Public Sites, Reservations and Dedications
The future right-of-way for the potential extension of Sharp Point Drive, as
necessary to serve the Side Hill P.D.P., is dedicated as Tract A by this replat.
SUMMARY OF CONCLUSIONS
A. The Drake Water Reclamation Plant Replat Project Development Plan is subject
to administrative review and the requirements of the Land Use Code (LUC).
B. No development standards within the R-C zoning district pertain to the replatting
of property.
C. The Drake Water Reclamation Plant Replat Project Development Plan complies
with all applicable General Development Standards, including the Plat Standards,
contained in Article 3 of the Land Use Code.

hereby approved by the Hearing Officer without condition.

FACTS AND FINDINGS
1. Site Context
The surrounding zoning and land uses are as follows:

The Drake Water Reclamation Plant was originally platted in 1988 and contained 23.44
acres. The first Replat was done in 1991 and included additional acreage for a new
total of 54.49 acres. The current request is the second replat and includes and includes
a new total of 70.81 acres.
2. Compliance with Article 4 and the RC Zoning District Standards:
There are no zone district standards that pertain to the platting or replatting of
property.
3. Compliance with Article 3 of the Land Use Code — General Development
Standards
A. Section 3.3.1 [B] — Lots
The proposed lots comply with the design standards in that the subdivision will
continue to have vehicular access to a public street (Drake Road), and the side
lot lines are at substantially right angles or radial to the street.
B. Section 3.3.1 [C] (1) - Public Sites, Reservations, and Dedications
The plat dedicates right-of-way and numerous drainage and utility easements as
necessary to accommodate existing and future public improvements. The
subdivision creates Tract A that is dedicated as future street right-of-way for the
extension of Sharp Point Drive. This future street extension will connect the

properly posted, legal notices mailed and notice
published.
PUBLIC HEARING
The Hearing Officer, presiding pursuant to the Fort Collins Land Use Code, opened the
hearing at approximately 4:30 PM on September 11, 2003 in Conference Room D at
281 N. College Avenue, Fort Collins, Colorado.
HEARING TESTIMONY, WRITTEN COMMENTS AND OTHER EVIDENCE:
The Hearing Officer accepted during the hearing the following evidence: (1) Planning
Department Staff Report; (2) application, plans, maps and other supporting documents
submitted by the applicant and the applicant's representatives to the City of Fort Collins;
and (3) a tape recording of testimony provided during the hearing. The LUC, the City's
Comprehensive Plan (City Plan), and the formally promulgated policies of the City are
all considered part of the evidence considered by the Hearing Officer.

This is a request to replat the City of Fort Collins Drake Water Reclamation Plant
located on the north side of East Drake Road. The site is approximately 70 acres in
size. The facility has added more land area in recent years for buffering purposes and
the replat incorporates the newly acquired area into one consolidated plat. There is no
new plant expansion or land development associated with this request.
