The proposed lots comply with the design standards in that each lot has
vehicular access to a public street, and the side lot lines are at substantially right
angles or radial to the street. The design of the adjacent platted roads is
unaffected.
B. Section 3.3.1 [C] (1) - Public Sites, Reservations, and Dedications
The plat will indicate proper dedication for utility easements as needed to serve
both lots.
SUMMARY OF CONCLUSIONS
A. The Replat of Lot 9, Tefft Acres Subdivision Project Development Plan subject to
administrative review and the requirements of the Land Use Code (LUC).
B. The Replat of Lot 9, Tefft Acres Subdivision Project Development Plan satisfies
the development standards of the UE zoning district.
C. The Replat of Lot 9, Tefft Acres Subdivision Project Development Plan complies
with all applicable General Development Standards, including the Plat Standards,
contained in Article 3 of the Land Use Code.
DECISION
The Replat of Lot 9, Tefft Acres Subdivision Project Development Plan, #12-03, is
hereby approved by the Hearing Officer subject to the following conditions:
1. This PDP approval is subject to final approval of the Taft Hill Seventh Annexation.
2. The Applicant shall ensure that the subdivision plat is modified prior to execution and
recordation to include an eight (8) foot -wide utility easement at the front of both lots
abutting Moore Lane.

1.4.9(E) and 2.1 of the Land Use Code.

FACTS AND FINDINGS
1. Site Context
The surrounding zoning and land uses are as follows:
N: UE; existing single family residential (Tefft Acres Subdivision)
S: UE; existing single family residiential (Tefft Acres Subdivision)
E: UE; existing single family residential (Tefft Acres Subdivision)
W: RL; UE; existing single family residential (Tefft Acres Subdivision)
The parcel will be annexed into the City as part of the South Taft Hill Seventh
Annexation on May 20, 2003.
The property was subdivided as Lot 9 of the Tefft Acres Subdivision in Larimer
County (date unknown).
2. Compliance with Article 4 and the UE Zoning District Standards:
The plat complies with the standards found under Article Four of the Land Use
Code. The applicant's request to plat the 7.08 acre parcel, in order to create two
new lots of 2.37 and 4.71 acres, complies with the following standards:
A. Section 4.1(B) — Land Use Standards
The proposed lots greatly exceed the minimum 1/2 acre lot size required in the UE
zone district. Further, the minimum lot width of one hundred feet will be exceeded
for both lots.
There was no evidence introduced at the hearing to contradict the Staff Report;
therefore, the Hearing Officer finds that the Subdivision is in conformance with
the applicable requirements found in Article 4 of the Land Use Code.

PUBLIC HEARING
The Hearing Officer, presiding pursuant to the Fort Collins Land Use Code, opened the
hearing at approximately 4:00 on April 24, 2003 in Conference Rooms C and D at 281
N. College Avenue. At the request of the Hearing Officer, the Hearing was continued to
May 8, 2003 at 4:00 p.m. in Conference Room A at 281 North College Avenue, Fort
Collins, Colorado.
HEARING TESTIMONY, WRITTEN COMMENTS AND OTHER EVIDENCE:
The Hearing Officer accepted during the hearing the following evidence: (1) Planning
Department Staff Report; (2) application, plans, maps and other supporting documents
submitted by the applicant and the applicant's representatives to the City of Fort Collins;
and (3) a tape recording of testimony provided during the hearing. The LUC, the City's
Comprehensive Plan (City Plan), and the formally promulgated policies of the City are
all considered part of the evidence considered by the Hearing Officer.
