The Replat of Lot 9, Tefft Acres - PDP meets the plat requirements located in Section 3.3.1 - Plat Standards located in Article 3 - General Development Standards. RECOMMENDATION: Staff recommends approval of the Replat of Lot 9, Tefft Acres Subdivision - PDP - #12-03. Tefft Acres, Replat of Lot 9 — Project Development Plan, #12-03 April 24, 2003 Administrative Hearing Page 3 A. The subdivision plat is in compliance with Section 3.3.1(A) General Provisions in that: 1) The subdivision plat will be filed and recorded only after having been approved by the Director of Planning, with such approval evidenced in writing on the plat and signed by the City Clerk. 2) No building permit or certificate of occupancy shall be issued for construction of any new principal building or no act which changes the use of any building shall be permitted until the subdivision plat is filed and recorded in the City of Fort Collins. B. The subdivision plat is in compliance with Section 3.3.1(B) Lots in that: 1) Each of the two lots are at least one-half (1/2) acre in size, as set forth in Division 4.1 UE — Urban Estate Zoning District, each lot has direct vehicular access to a public street (Moore Lane), and the side lot lines are substantially at right angles or radial to the street line. 2) The general layout of lots, roads, driveways, utilities, drainage facilities and other services within the proposed development have been previously established in the Tefft Acres Subdivision. C. The subdivision plat is in compliance with Section 3.3.1(C) Public Sites, Reservations and Dedications in that: 1) An applicant shall be required to dedicate rights -of way for public streets, drainage easements and utility easements as needed to serve the area being platted. The rights -of -way for Moore Lane and Moffett Drive were previously dedicated by the Tefft Acres Subdivision plat and the drainage and utility easements necessary to serve this lot will be dedicated with the Replat of Lot 9, Tefft Acres plat, if approved and filed. 2) Reservation of sites for flood control, open space and other municipal uses shall be made in accordance with the requirements of this Land Use Code. This criteria is not applicable to the Replat of Lot 9, Tefft Acres - PDP request. 5. Findings of Fact/Conclusion: A. The Replat of Lot 9, Tefft Acres - PDP meets the procedural requirements located in Division 2.1 - General Procedural Requirements, Division 2.2 - Common Development Review Procedures for Development Applications, and Section 2.4 - Project Development Plan located in Article 2 - Administration. Background: The surrounding zoning and land uses are as follows: N: UE; existing single family residential (Tefft Acres Subdivision) S: UE; existing single family residential (Tefft Acres Subdivision) W: POL; City -owned, future southwest community park site E: UE; existing single family residential (Tefft Acres Subdivision) This property was annexed into the City as part of the South Taft Hill Seventh Annexation in May, 2003. The property was subdivided as Lot 9 of the Tefft Acres Subdivision in Larimer County (date unknown). 2. Purpose of the Subdivision: The purpose for the replatting of Lot 9 of the Tefft Acres Subdivision is to create two legally subdivided lots on a property that presently is one lot in the subdivision. The replat will create two lots, both fronting on Moore Lane, with Lot 9A being 2.37 acres in size and Lot 9B being 4.71 acres in size. The expressed intent of the applicant is to construct a new single family residence on Lot 9B at some time in the future; however, no site layout or building plans for a new structure are being reviewed at this time. The existing single family residence will remain on Lot 9A. Staff has determined that there is no detriment to the development plan associated with the platting of two lots. 3. Article 2 - Administration: The Replat of Lot 9, Tefft Acres Subdivision - PDP complies with the applicable requirements of the LUC, specifically the procedural requirements located in Division 2.1 - General Procedural Requirements, Division 2.2 - Common Development Review Procedures for Development Applications, and Section 2.4 - Project Development Plan located in Article 2 - Administration. 4. Article 3 - General Development Standards: The Replat of Lot 9, Tefft Acres Subdivision - PDP complies with the applicable requirements of the LUC, specifically the plat requirements located in Section 3.3.1 - Plat Standards located in Article 3 - General Development Standards. The request is to replat one lot, 7.08 acres in size, into two lots. Lot 9A would be 2.37 acres in size and Lot 913 would be 4.71 acres feet in size. There is one existing single family residence on the property, which is addressed as 3209 Moore Lane. It is located on the west side of Moore Lane, south of Moffett Drive, north of West Horsetooth Road, and west of South Taft Hill Road. The property is in the UE — Urban Estate Zoning District.
