angles or radial to the street. The design of the adjacent platted road is
unaffected.
B. Section 3.3.1 [C] (1) - Public Sites, Reservations, and Dedications
The plat indicates proper dedication for utility easements as needed to serve
both lots. As the existing right-of-way for Loomis Street exceeds adopted
standards for width, no right-of-way dedication is needed.
SUMMARY OF CONCLUSIONS
A. The Gamble Subdivision Replat Project Development Plan is subject to
administrative review and the requirements of the Land Use Code (LUC).
B. The Gamble Subdivision Replat Project Development Plan satisfies the
development standards of the NCM zoning district.
C. The Gamble Subdivision Replat Project Development Plan complies with all
applicable General Development Standards, including the Plat Standards,
contained in Article 3 of the Land Use Code.
DECISION
The Gamble Subdivision Replat Project Development Plan, #15-03, is hereby approved
by the Hearing Officer without cQndition.

FACTS AND FINDINGS
1. Site Context
The surrounding zoning and land uses are as follows:
N: NCM; existing single family housing (West Side Addition), Sycamore
Street;
LMN; Fort Collins Utilities Facility at 700 Wood Street; railroad tracks;
S: NCM; existing residential (West Side Addition);
W: NCM; existing residential (West Side Addition);
E: LMN; existing residential (Golding Dwyre Replat of West Side Addition)
This property was annexed into the City as part of the West Side Addition
Annexation in January of 1887. The site constitutes lots 9, 10 and the south 20
feet of lot 11 of the original West Side Addition.
2. Compliance with Article 4 and the NCM Zoning District Standards:
The plat complies with the standards found under Article Four of the Land Use
Code. The applicant's request to replat the parcel, in order to create two new
lots, each of 6,300 square feet, complies with the following standards:
A. Section 4.7(D) — Land Use Standards
The proposed lots exceed the minimum 40-foot width required in the NCM zone
district. Further, there is no change in the density of development as the two
existing single family houses located within the development comply with the
density standards of this section, nor will the replat trigger non-compliance.
There was no evidence introduced at the hearing to contradict the Staff Report;
therefore, the Hearing Officer finds that the Subdivision is in conformance with
the applicable requirements found in Article 4 of the Land Use Code.
3. Compliance with Article 3 of the Land Use Code — General Development
Standards
A. Section 3.3.1 [B] — Lots
The proposed lots comply with the design standards in that each lot has
vehicular access to a public street, and the side lot lines are at substantially right

properly posted, legal notices mailed and notice
published.
PUBLIC HEARING
The Hearing Officer, presiding pursuant to the Fort Collins Land Use Code, opened the
hearing at approximately 4:00 PM on June 30, 2003 in Conference Room A at 281 N.
College Avenue, Fort Collins, Colorado.
HEARING TESTIMONY, WRITTEN COMMENTS AND OTHER EVIDENCE
The Hearing Officer accepted during the hearing the following evidence: (1) Planning
Department Staff Report; (2) application, plans, maps and other supporting documents
submitted by the applicant and the applicant's representatives to the City of Fort Collins;
and (3) a tape recording of testimony provided during the hearing. The LUC, the City's
Comprehensive Plan (City Plan), and the formally promulgated policies of the City are
all considered part of the evidence considered by the Hearing Officer.

The Applicants have submitted a request to reconfigure two lots and a portion of one lot,
held in common ownership, into two lots. Each newly configured lot comprises 6,300
square feet in area. One house is located on each of the lots; one is an historic house
recently relocated to the development.
