Collins, CO 80521 FROM: Bill Veio, Manager, Solitaire Homes, LLC RE: APPEAL OF PLANNING DIRECTOR'S DECISION TO NOT EXTEND PDP EXTENSION DEADLINE FOR FINAL PLAT APPROVAL FOR SANCTUARY WEST SUBDIVISION FOR 112 HOMES (This is a Type 1 Review) Solitaire Homes has been diligently pursuing the Final Plat Process and has submitted all required mylars for the Final Plat and all Utility drawings and signed Easements. The Development Agreement (DA) was the only document remaining unsigned to meet all the conditions for project approval on January 10, 2011, Solitaire Homes began requesting a preliminary draft of the DA as early as April 2011 on up through December 2011 but never received a copy. The first time Solitaire Homes received a draft of the DA was on Jan.10, 2012 with a 4"h City revision being received at 10 minutes to 5:00 pm on that day. This is certainly riot a reasonable amount of time to review, revise, or amend such a document. I replied to the City in the evening of Jan.10, 2012 stating the DA could not be signed as presented due to two Ditch Company clauses and a stormwater clause that were incorrect. Other clauses that were expected to be there and had been mentioned in prior Stormwater meetings were omitted from the DA.. (Section 26-544 & 546, et al) On January 12, 2012 I received a letter from the Planning Director stating that the PDP for Sanctuary West had expired because the utility drawings could not be fully signed and the DA was not signed by the Developer. Therefore the Subdivision Plat could not be signed. I believe the Planning Director has the authority to approve the development with conditions, grant a hardship extension, or provide a 30-day extension in order to complete the drafting and signing of the DA. There are many extenuating circumstances created by the City staff that contributed to the project submittals bumping up against the deadline. The inability of the City to provide at least a draft of the Development Agreement when the engineering for the project has been complete for over 6 months, except for very minor corrections, is the primary reason the DA could not be signed on the day, Jan.10, 2012 it was received. We are requesting that the Planning Director allow a 30-day period to complete the drafting and signing of the DA, so there is no hardship to the Developer, and the project can be approved and move forward with development this Spring. He's characterizing the expiration of the PDP for Sanctuary West as an appeal to a Type 1 Administrative Review. I think everyone agrees that there are no provisions for appeal in this case. Paul.....will you be the one to respond to Mr. Veio AND return his $100 fee? We won't cash the check. Please let me know. Wanda 1 /27/2012
