FINDINGS OF FACT/CONCLUSIONS
After reviewing the 1101 Academy Court Wireless Telecommunication
Equipment Project Development Plan, #26-03, staff makes the following findings
of fact and conclusions:
1. The proposed land uses are permitted in the Industrial district.
2. The Project Development Plan complies with all applicable district
standards of Section 4.23 of the Land Use Code, Industrial zone
district.
3. The Project Development Plan complies with all applicable General
Development Standards contained in Article 3 of the Land Use Code.
RECOMMENDATION:
Staff recommends approval of 1101 Academy Court Wireless

prevent future telecommunication carriers from co -locating upon
this structure. All parties involved must negotiate in good faith to
achieve co -location of telecommunication equipment on existing
structures.
Setbacks — The ground equipment will be approximately 16 feet
from the eastern property line, adjacent to the Burlington Northern
Railroad. Since this is not a structure, it is not subject to the setback
criteria within Sections 4.23 or 3.5.3 of the land use code.
Wireless Telecommunication Equipment — The antenna equipment
will have the same material and finish as the existing utility pole.
Landscaping and Fencing — The equipment enclosure will be
located within an existing outdoor storage yard. The yard is
bordered on the east and west by railroad tracks. Due to its
location, no additional landscaping or screening is proposed. The
ground equipment will not be visible from Riverside Avenue.
Lighting — The only lighting associated with the project is service
lighting which will be included within the equipment enclosure. This
lighting would only be used for services performed when it is dark.
Historic Sites and Structures — The wireless telecommunication
equipment is not located on a historic structure, nor is the site
located within a historic district.
Stealth Technology — The wireless telecommunication equipment is
located on an existing metal electric utility pole. The poles
themselves are not considered an attractive asset to the
neighborhood, and is strictly a utility function. The antenna design
will not further detract from the utility nature of the poles
themselves. Since the are is located within an industrial district, and
not readily visible from Riverside Avenue or from nearby residential,
a standard antenna array has been proposed.
4. Neighborhood Information Meeting
Based on the nature and the materials presented as part of the
project submittal, and the limited impacts on adjacent property
owners, a neighborhood meeting was not held for this application.

EXECUTIVE SUMMARY:
The project development plan has been reviewed in accordance with the
applicable requirements of the Land Use Code (LUC) and was found to be in
substantial compliance with the following:
The process located in Division 2.1 — General Procedural Requirements, Division
2.2 — Common Development Review Procedures for Development Applications,
and Division 2.4 — Project Development Plan located within Article 2 —
Administration; and the design standards located within Article 3 — General
Development Standards; and the standards located in Section 4.23, Industrial
district (1) of Article 4 — Districts.
ANALYSIS:
Background
The surrounding zoning and land uses are as follows:
N: I — Railroad Right -of -Way
S: I — Storage Yard
E: I — Railroad Right -of -Way
W: I — Storage Yard
The property was annexed in April, 1984 as part of the Upland
Annexation.
2. Division 4.23 of the Land Use Code, Industrial District
The proposed use of wireless telecommunication equipment is permitted
in the Low -Density Residential zone district subject to Administrative
Review.
3. Division 3.8, Supplemental Regulations
A. Section 3.8.13, Wireless Telecommunication
Location — The wireless telecommunication equipment is proposed
to be located on an existing non-residential structure within the
Industrial zone district.
Co -location — There are no other existing wireless
telecommunication facilities or equipment within the general area
which the applicant may co -locate upon. The applicant may not

PROJECT DESCRIPTION:
1101 Academy Court is a Project Development Plan for a wireless
telecommunication antenna.to be located on the top of an existing 95-foot electric
transmission pole. The pole is located within an outdoor storage lot behind the
principle business building. The site is located at the end of Academy Court, east
of Riverside Avenue. The pole is a part of the Platte River Power Authority
electric transmission line which parallels the Union Pacific Railroad. The antenna
array will consist of 12 individual antennas, located in three groups of four. The
individual antenna will be mounted on a triangular platform which is then
mounted to the transmission pole. The support equipment will be located about
55 feet south of the pole. The equipment will be concealed within a 12 feet by 26
feet equipment enclosure. The enclosure will be located within the storage area,
adjacent to the transmission pole.
The property is zoned I — Industrial.
RECOMMENDATION: Approval
