I also concur that Current Planning should take the lead in working with the Duncans as we proceed through the review process. Just so you're aware of it, the development includes demolition of the Inn at Fort Collins and construction of an Eckerd drugstore. The formal project name is the Eckerd Drug- College and Drake Project Development Plan. Ted Shepard is the Project Planner. Please let me know if you have further questions. Cameron >>> Steve Roy 10/07/03 11:31 AM >>> Sarah, as I mentioned on the phone, I think it's fine to send the Duncans' letter re the proposed redevelopment of the Inn. of Fort Collins site to the Planning and Zoning Board, so as to make their position known to the Board and part of the record. Cameron, it seems to me that the best way to accomplish that would be through you. Does that work? Also, I'm assuming that this will be a Type 11 review rather than a Type I review. If that's not correct, please let Sarah and me know right away. In terms of a response to the Duncans from Ray, I would suggest something along the following lines: Dear Mr. and Mrs. Duncan, Thank you for your letter regarding the proposed redevelopment of the Inn of Fort Collins site. I have forwarded your letter to Cameron Gloss, the City's Current Planning Director, and have asked that he share it with the City planner assigned to the project and with the Planning and Zoning Board. This will make your letter part of the record of the proceedings before the Board when this proposal is presented to the Board for its consideration. In terms of my own involvement, I will need to refrain from taking any position in that matter --not because I am not interested in your concerns but because these kinds of City decisions are "quasi-judicial" decisions. This means that the City decision makers must remain impartial and not take positions in advance of the hearings at which the development proposals are considered. Under the City Code, a decision by the Planning and Zoning Board on a development proposal can be appealed to the City Council. I have no way of knowing whether such an appeal may occur with regard to this particular development proposal, so I need to be careful not to get involved in the matter or take a position as to the merits of the proposal, in case it comes to Council on appeal. If it does, then I and the other Council members will need to base our decision on the record of the proceedings before the Board (which will include your letter) and the arguments presented at the appeal hearing. If you have any additional questions or concerns about our process, please do not hesitate to contact me. Sincerely, Sarah, let me know if you or Ray need anything more. Steve
