This letter is to
i request input in the proposed construction plans to
the 2600 block of South College Avenue, and
share aspects of our personal health situation.
First, I, Dean Duncan, have been advised I must go to the
Cleveland Clinic in Cleveland, Ohio, for open-heart surgery; and,
thus, will be out-of-town until mid -November, 2003. After my wife's
and my return, my recovery time will be two to three:months, pre-
venting us from attending any public meetings to voice opinions and
requests. This letter, ergo, i9 to communicate our concerns.
We are aware (even though no official notice has been sent to
us) that our residential property is facing a major change. We
understand that the Inn of Fort Collins, situated North of The Moot
House Restaurant, is under consideration for demolition and that
a one-story drugstore will be constructiBdi We also understand that
these plans include a parking -lot to be situated directly WEST of our
property linei.e., three Feet away from our back yard.
In 1998, thinking that the windowless, two-story motel located
only three feet from our WEST property line would remain in its present
location, providing an effective sound barrier and 100% privacy for
pr home we updated the house inside and the landscape. We spent
00000.00 with local trade people and merchants.
Since we will be out-of-town for the next month and a half for
necessary surgery, we are requesting that the proposed plans for this
project include the following components:
the property developers construct on their EAST property
line a ten to twelve foot fence in order to
- insure the bit- lights will be diffused to a degree
- maintain some privacy for us
- serve as a sound barrier
the property developers plant substantial evergreen Trees
along their BAST property line.
We have been a good neighbor with The Moot House and the Inn of
Fort Collins who have been in their present location when we purchased
our home. We are confident that if the above requests are included in
both future proposed plans and and any final construction , surrounding
home properties will have a degree of property protection while not
hurting anyone's business.

Dear Mr. and Mrs. Duncan:
Thank you for your October 3, 2003, letter regarding the proposed redevelopment of the Inn of Fort
Collins site. I forwarded your letter to Cameron Gloss, the City's Current Planning Director, and asked
that he share it with the City planner assigned to the project and with the Planning and Zoning Board.
This will make your letter part of the record of the proceedings before the Board when this proposal is
presented to the Board for its consideration.
In terms of my own involvement, I will refrain from taking any position in that matter --not because I am
not interested in your concerns but because these kinds of City decisions are "quasi-judicial" decisions.
This means that the City decision -makers must remain impartial and not take positions in advance of the
hearings at which the development proposals are considered.
Under the City Code, a decision by the Planning and Zoning Board on a development proposal can be
appealed to the City Council. I have no way of knowing whether such an appeal may occur with regard
to this particular development proposal, so I need to be careful not to get involved in the matter or take a
position as to the merits of the proposal, in case it comes to Council on appeal. If it does, then I and the
other Council members will need to base our decision on the record of the proceedings before the Board
(which will include your letter) and the arguments presented at the appeal hearing.
