College Avenue Fort Collins, CO 80525 RE: Eckerd Drugstore at College and Drake, Project Approval and Abandonment Procedures Mr. and Mrs. Lee: I have been informed that there are some concerns regarding the dedication of easements for the Eckerd at College and Drake Project, and what could be done if the development proposal "falls through" and Eckerd no longer wishes to construct the project after the easements have been dedicated and the plans have been filed. According to the City of Fort Collins Land Use Code, the approved plans for the Eckerd Project may be abandoned if no one wishes to use them any longer and the criteria for approving the abandonment are met (LUC 2.1.4(A)2 and 2.1.4 (C) 1&2). In order to abandon the approved plans, a Major Amendment abandoning those plans must be submitted to the City and approved by the Planning and Zoning Board. The Planning and Zoning Board would also be the body that would approve the vacations of the easements dedicated with the project. City staff foresees no problems with completing the abandonment of the project and vacation of the easements, should Eckerd fail to proceed with the project. This abandonment would have the effect of canceling any easements dedicated for the Eckerd Project.
