Re: The Property located the southeast corner of College Ave and Drake Road, City of Fort
Collins, County of Larimer, State of Colorado (the "Premises").
Dear Mr. Willman:
This is to confirm the following information:
1. The current zoning classification of the Premises is Commercial. A copy of the applicable
ordinance, sections, permitted uses, and performance standards are enclosed.
2. The proposed Project Development Plan (P.D.P.) for the Premises was approved December
5, 2003 and indicates a one-story building used for retail purposes (the "Project"), which building and
use are in compliance with the above classification and zoning ordinances.
3. The zoning classification of the Premises has not changed since the Project Development
Plan was approved.
4. The land use designation for the Premises is retail, which permits the approved square
footage of 13,824 square feet. of commercial leasable space per acre. (The City of Fort Collins does not
use a floor -to -area ratio by which to review commercial development.)
5. No variances, conditional use permits or special use permits are required or pending for the
approved Project Development Plan.
6. The Project, as approved, complies with all applicable subdivision and platting requirements
and can be conveyed by the above legal description without the filing of a plat or a replat.
7. The Project Development Plan is subject to and, if constructed pursuant to the approved
development plans, will meet all the applicable standards of the City of Fort Collins Land Use Code. In
particular, standards relating to number of parking spaces, building and parking lot setbacks and building
height have been evaluated and found to be in compliance with the City of Fort Collins Land Use Code.
8. The proposed use of the Premises is not a non -conforming use. [If non -conforming, the
proposed improvements may be restored to the proposed use and dimensions described on the approved
development plans in the event the improvements were to be damaged or destroyed.
