Fort Collins, CO 80524 March 4, 2003 Dear Larry and Diana, I appreciate both of you taking the time to meet with me Friday February 28, 2003 regarding the proposed Rezone of your property (Parcel # 87072-00-005). During this meeting, you brought it to my attention of past discussions with the City and clear understanding that this property should remain zoned Industrial (I) and the proposed Rezone to Low Density Mixed -Use Neighborhood (LMN) conflicts with your original expectations. As the City co -project manager, along with the County in developing the East Mulberry Corridor Plan, we made every effort to properly notify and encourage participation of property owners within the study area throughout the planning process. As a result of numerous public meetings and other outreach opportunities, both the City and County jointly adopted the Plan in September 2002. The recommendation of the Plan, along with a concurrent recommendation of the City Structure Plan Map, showed LMN land use designation for your property. Since this property is located outside of the Plan study area, you were not included in the mailing distribution list. Furthermore, you informed me that you also were not aware of the public meetings and Hearings held in conjunction with the Plan that were advertised. In listening to your concerns, and assessing the situation, I will remove this parcel from the Rezone Petition and agenda item for the Planning and Zoning Board Hearing (3-6-03) and City Council Hearing (3-18-03). The existing Industrial Zoning will remain. As mentioned in our meeting, a follow-up amendment to the East Mulberry Corridor Plan and City Structure Plan Map will need to be adopted to change the land use designation from LMN to I. I anticipate this adjustment will take place later this year in order to package other changes together. I hope this summary reflects your understanding of our discussion.
