Good morning all,
Terrence Hoagland sent us these revised site and landscape plans earlier this week. In addition, I
received the nationwide permit application from Bill Veio yesterday, also attached.
As each of you have indicated to me that the revised wetland mitigation plans could affect your prior
comments, I'm sending you these plans so you can verify any additional comments you might need
to provide to the applicant.
Steve O., please note that the conceptual park design with the ultimate, master plan channel
installed can be found on page 10 of the attached pdf (sheet 9A of 11). You and I will need to
determine whether this conceptual design meets both the site's ultimate mitigation requirements and
the park requirements for the site's zoning district.
As I'm leaving town for the holidays on 12/16 (returning on 1/3), it is my intention to return comments
back Terrence and Bill by the middle of next week. That way, we would still have approximately one
week to resolve any of my comments prior to my departure.

Section 4.5(D)(6) Small Neighborhood Parks in the Low Density Mixed -Use
Neighborhood District of the Land Use Code states:
Either a neighborhood park or a privately owned park, that is at least one (1) acre in
size, shall be located within a maximum of one-third (1/3) mile of at least ninety (90)
percent of the dwellings in any development project of ten (10) acres or larger as
measured along street frontage.
Based on the information provided on Sheets 4, 7 and 9A it is still somewhat
difficult to determine if the entire park site satisfies the intent of Sections 4.5(D)(6)
(c) Facilities & 4.5(D)(6)(e) Storm Drainage of the LUC. The code states that
"such parks shall consist of multiple -use turf areas, walking paths, plazas,
pavilions, picnic tables, benches and other features for various age groups to
enjoy"; and, that "when integrating storm drainage and detention functions to
satisfy this requirement, the design of such facilities shall not result in slopes or
gradients that conflict with other recreational and civic purposes of the park".
Certainly Outlot K, on the north side of Barton Drive, can satisfy the
aforementioned requirement about facilities; however, it is only a portion of the
approved park site and is 0.25 acre in size. The concern relates to Outlot C, on
the south side of Barton Drive. This portion of the approved park site is 0.73 acre
in size and is proposed to contain a water quality pond and (presumably) some
area for wetland mitigation. Although the "facilities" requirement does not need to
be met on all portions of the park it is still important to provide and maintain
some level of "park" or "open space" experience. The concern is that the wetland
mitigation or natural area component (and possibly the water quality pond) may
not do this, leaving a relatively small park site for the use and enjoyment of the
residents of Sanctuary West.
More detailed information for Outlot C is needed to help determine if Section 4.5
(D)(6) of the LUC is being met.

Steve: Solitaire Homes agreed to relocate the Wetlands from the approved PDP
location in the East-West channel to the proposed Park.Open Space location,
based upon Lindsay's insistence and your indication to us that the combined Outlot
C & D areas and the wetlands would satisfy the City's 1-acre Park requirement.
Furthermore, we have added Public Trails thru the East- West stormwater channel
for use by residents & neighbors for Open Space, sight-seeing, walking, bicycling,
picnicking, jogging, roller-blading, frisby tossing, and for hanging out & gathering.
This area adds another 3.1 acres of Public Park/Open Space to the adjacent 1.905

and Outlot K (.245acres). There should be justification for counting at least 1-acre
of this 5 acres of continuous and contiguous property as meeting the Public Park
requirement.
The Wetlands Mitigation & Monitoring report. Randy's dad passed away & he
may not be able to modify the report sections any time soon that Terry (COE) and
Lindsay would like to see. I am filling in to get a draft to the COE &
Lindsay tomorrow or Wednesday. I'll send you a review copy FIRST for your
feedback.
Whenever you have the revised 8.5 x 11 exhibits, please email them to include in
the report.
