6. Mitigation and monitoring Plan (Lindsay Ex) — The mitigation and monitoring plan are to be a component of
the Development
Agreement. Bill, you have indicated to Lindsay you will provide her with a draft of the plan by Friday
afternoon. Please note it
is extremely likely she will have comments on this plan; please be prepared to quickly address these
comments.
7. Development Agreement (Sheri Langenberger) — Staff expects to have our draft language ready for
review by the City's
attorney by today (Friday). This means that you will have very little time to review the DA on your part.
Thus, if you have any
comments on the DA, please submit them back to us as soon as possible.
Again, on behalf of my colleagues, I can only reiterate that we are doing our best to process all of this information
as it is returned to us. Thank you, in advance, for the timely submission of these remaining items.

d. The drainage sheets and grading sheets must reference the Overall Floodplain sheet.
e. Repeat Comment from April 29, 2011; Please add the following notes to the Plat, Landscape
Plan, Site Plan, Utility Plans (General Notes), Grading Plan, and Overall Floodplain Sheet: (1)
Portions of this property are located in the City 100-year flood fringe and floodway of the West
Vine Basin, and are subject to the requirements of Chapter 10 of City Code. (2) No storage of
materials or equipment shall be allowed in the floodway, whether temporary (during construction)
or permanent. (3) An approved floodplain use permit is required for all site elements
(landscaping, fencing, roadway, detention ponds, bike paths, parking lot, utilities etc.) in the
floodplain prior to mobilization. (4) No -rise certification is required for all site work including
landscaping and fencing within the floodway. Re -certification of no -rise is required for as -built
conditions. (5) See floodplain exhibit on Sheet 70 for cross-section locations, BFE lines, and
other additional floodplain information.
f. Remove all references to Larimer County Floodplain Overlay Districts from the general notes.
g. All BFEs must be labeled on the Overall FP Sheet.
h. Repeat Comment from April 29, 2011; Please make sure both FW lines are represented on the
Overall FP Sheet.
i. Repeat Comment from April 29, 2011; Please add benchmark information and vertical datum to
the Overall FP Sheet.
j. Landscape plans; change SW Note 1 reference from "Frine" to "Fringe".
k. Repeat Comment from April 29, 2011; Drainage report must reference the date of the URS
floodplain modeling report.
I. Repeat Comment from April 29, 2011; Drainage report must include a statement of why
floodplain modeling was necessary. This is not currently clear.
m. Drainage report section III, A, Regulations, must include a reference to Chapter 10 of the City of
FC Municipal Code for 100-year floodplain and floodway areas.
n. Repeat Comment from April 29, 2011; Drainage report must discuss all floodway construction,
why Ch. 10 applies to proposed floodway construction, how floodway construction will meet no -
rise certification standards, and how it will be re -certified for no -rise with as-builts.
o. Site boundaries in the Drainage Report appendix figures must be shown clearly and must be to
scale.
4. Overall molars (All Staff) — Because staff has not seen a complete set of Utility Plans (with a sufficient time
for review) since
2010, we are generally okay with heading to mylars (once the floodplain, road design, and platting issues
have been
addressed). However, there is not 100% confidence amongst City Staff to say that we know we'll be able
to sign the mylars
when they are initially submitted. Due to this, we highly recommend that the mylars are submitted by
Monday mornin4,
with all of the corrections listed in this email completed. That way, if/when sheets need to be sent back,
there is sufficient
time to correct them.
a. In addition, the Utility Plan mylars need the signatures from Poudre School District and the New
Mercer Ditch Company before submittal to the City.
5. Road design concerns (Sheri Langenberger) — Sheri has also been working with you on the road design
issues. Note that
some of the grading changes that are being made could trigger additional Stormwater review. Additional
corrections to the
street profiles (utility plans) will be needed - Sheri is in the process of reviewing the revisions that were
returned to her and

Bill and Terence,
In light of the Tuesday, January 10th drop -deadline at 5 p.m., City Staff met yesterday to generate and
provide a list of our remaining needs to get to final approval. They are lengthy and we won't mince words
— we are very concerned about the ability to complete all of the items listed below. However, City Staff is
committed to doing what we can to help you get to approval. That said, here is our list:
1. Plat, Site Plans, Utility Plans (Jeff County and John Von Nieda) — has minor corrections that need
to be made, please note
the following:
a. The reception numbers from the easements, see below, must be on the Plat.
b. The reception numbers from the easements will need to be added to sheets 3 & 4 of the
Site Plans as well.
c. Both current and proposed floodway, as well as current and proposed floodplain must be
shown on Plat. Recommend showing by different line types due to the already "busy"
nature of Plat.
d. Corrections need to be made to the legal description.
e. All Outlots must be labeled with the correct easement descriptions on the Plat.
f. Remove the project benchmarks from the Plat.
g. Is Steve Lund still signing this Plat? If not, please change the Surveyor's Statement.
h. Add the correct floodplain exhibit sheet # in standard note "e".
i. There are several easement widths missing on the Plat.
j. Please make sure all monuments found or set are shown & labeled on the Plat.
k. More information is needed for several easements on the Plat. All easements must be
locatable.
I. We still need to see Utility Plan sheet 23.
m. Based on the Utility Plans received on 12/20/11, there are details on sheets 64 & 66 that
have outdated details from the 1980's. These need to be replaced with up-to-date details.
n. We received a revised Plat from King Surveyors at 9:39 a.m. 1/06/12, but have not had
time to review it completely.
2. Easements (Sheri Lanoenberger) — All the easements need to be provided in acceptable final
format with all signatures and
correct legals before the utility plans can be signed.
a. Sheri sent a lengthy email on Wednesday detailing her concerns about the easements;
both Stormwater and Engineering will need to review the revised easements before final
approval can be granted. Note that there are concerns regarding attorney's certifications
(4 of the easements) and the legal description of the parcels (6 of the easements).
b. The legals are being reviewed on Friday and any additional changes beyond what has
already been noted will be provided as soon as possible.
c. Sheri will be meeting with Real Estate Services Friday morning. Any issues or concerns
that come out of that meeting will be provided after that meeting.
3. F000dplain comments (Brian Varrella) — Brian saw the revised Utility Plans for the first time today;
he did not have a chance
to go through all of his comments from the April 29, 2011 staff letter, but did note several of his
