FINDINGS OF FACT/CONCLUSIONS
After reviewing the Summitview Community Church Wireless Telecommunication
Equipment Project Development Plan, #34-03, staff makes the following findings
of fact and conclusions:
1. The proposed land uses are permitted in the Public Open Lands
district.
2. The Project Development Plan complies with all applicable district
standards of Section 4.10 of the Land Use Code, Public Open Lands
zone district.
3. The Project Development Plan complies with all applicable General
Development Standards contained in Article 3 of the Land Use Code.
RECOMMENDATION:
Staff recommends approval of Summitview community Church Wireless
Telecommunication Equipment Project Development Plan, #34-03

this structure. All parties involved must negotiate in good faith to
achieve co -location of telecommunication equipment on existing
structures.
Setbacks — The ground equipment will be 31 feet from the sidewalk
along Drake Road. Since this is not a structure, it is not subject to
the setback criteria within Sections 4.10 or 3.5.3 of the land use
code.
Wireless Telecommunication Equipment — The antenna equipment
will have the same material and finish as the existing utility pole.
Landscaping and Fencing — The equipment enclosure will be
located behind the curbside landscaping along Drake Road. The
six-foot wooden fence will include masonry posts every eight feet.
Five additional evergreen trees will be planted in front of the
enclosure to provide additional screening. All existing landscaping
will remain.
Lighting — The only lighting associated with the project is service
lighting which will be included within the equipment enclosure. This
lighting would only be used for services performed when it is dark.
Historic Sites and Structures — The wireless telecommunication
equipment is not located on a historic structure, nor is the site
located within a historic district.
Stealth Technology — The wireless telecommunication equipment is
located on an existing metal electric utility pole. The poles
themselves are not considered an attractive asset to the
neighborhood, and is strictly a utility function. The antennas have
been designed to minimize their appearance, considering the
location directly adjacent to Drake Road and the adjacent
residential. The design will have less of an impact than the existing
antennas located to the east of the site, in front of the Preserve
Apartments.
4. Neighborhood Information Meeting
Based on the nature and the materials presented as part of the
project submittal, and the limited impacts on adjacent property
owners, a neighborhood meeting was not held for this application.

EXECUTIVE SUMMARY:
The project development plan has been reviewed in accordance with the
applicable requirements of the Land Use Code (LUC) and was found to be in
substantial compliance with the following:
The process located in Division 2.1 — General Procedural Requirements, Division
2.2 — Common Development Review Procedures for Development Applications,
and Division 2.4 — Project Development Plan located within Article 2 —
Administration; and the design standards located within Article 3 — General
Development Standards; and the standards located in Section 4.10, Public Open
Lands (POL) of Article 4 — Districts.
ANALYSIS:
Background
The surrounding zoning and land uses are as follows:
N: POL — Ross Natural Area
S: RL — Church
E: MMN — Multi -Family Residential
W: POL — Ross Natural Area
The property was annexed in September 1965 as part of the Fourth
College Annexation.
2. Division 4.10 of the Land Use Code, Public Open Lands District
The proposed use of wireless telecommunication equipment is permitted
in the Public Open Lands zone district subject to Administrative Review.
3. Division 3.8, Supplemental Regulations
A. Section 3.8.13, Wireless Telecommunication
Location — The wireless telecommunication equipment is proposed
to be located on an existing non-residential structure within the
Public Open Lands zone district.
Co -location — There are no other existing wireless
telecommunication facilities or equipment within the general area
which the applicant may co -locate upon. The applicant may not
prevent future telecommunication carriers from co -locating upon

PROJECT DESCRIPTION:
Summitview Community Church is a Project Development Plan for a wireless
telecommunication antenna to be located on the top of an existing 75-foot electric
transmission pole. The pole is located within the Drake Road Right -of -Way,
adjacent to the parking lot for the Summitview Community Church. The pole is a
part of the Platte River Power Authority electric transmission line which parallels
Drake Road. The antenna array will consist of three individual antennas, directly
attached to a support pole, which is attached to the side of the transmission pole.
The supporting ground equipment will be located in the adjacent Summitview
Community Church Parking lot. The equipment will be concealed within a 25 feet
by 17 feet fenced area at the entrance to the lot. The fence will include masonry
columns for greater aesthetics. Additional evergreens will be planted to help
provide additional screening of the equipment.
The property is zoned POL — Public Open Lands.
RECOMMENDATION: Approval
