SUMMARY OF CONCLUSIONS
A. The Heckart Subdivision Project Development Plan is subject to administrative
review and the requirements of the Land Use Code (LUC).
B. The Heckart Subdivision Project Development Plan complies with all applicable
District Standard contained in Article 4 of the Land Use Code
C. The Heckart Subdivision Project Development Plan complies with all applicable
General Development Standards, including the Plat Standards, contained in
Article 3 of the Land Use Code.
DECISION
The Heckart Subdivision Project Development Plan, #35-03, is hereby approved by the
Hearing Officer without condition.
Dated this 24th day of March 2004, per authority granted by Sections
1.4.9(E) and 2.1 of the Land Use Code.

FACTS AND FINDINGS
1. Compatibility with Surrounding Uses:
The surrounding zoning and land uses are as follows:
N: LMN;
existing single family residential
S: LMN;
existing single family residential
E: LMN;
existing single family residential
W: LMN
vacant land, existing single-family residential
The property was annexed into the City as part of the West LaPorte Avenue Addition
Annexation in April 1970 and has not been previously subdivided.
2. Compliance with Article 4 and the LMN Zoning District Standards:
The proposed subdivision is exempt from the Density Standards defined by
Section 4.4 D (1) in that the property is less than 20 acres in size and located
within the Infill area". There are no other Land Use Standards applicable to the
development.
3. Compliance with Article 3 of the Land Use Code — General Development
Standards
A. Section 3.3.1 [B] — Lots
The proposed lot complies with the design standards in that the lots provide
vehicular access to a public street, and the side lot lines are at substantially right
angles or radial to the street.
B. Section 3.3.1 [C] (1) - Public Sites, Reservations, and Dedications
The plat includes dedication of public utility and drainage easements, access,
and emergency access easements, necessary to serve the subject property.
Forty-two (42) feet of right-of-way will be dedicated via the subdivision plat in
order to accommodate future widening of LaPorte Avenue.

PUBLIC HEARING
The Hearing Officer, presiding pursuant to the Fort Collins Land Use Code, opened the
hearing at approximately 5:40 p.m. on March 23, 2004 in Conference Room A at 281 N.
College Avenue, Fort Collins, Colorado.
HEARING TESTIMONY, WRITTEN COMMENTS AND OTHER EVIDENCE:
The Hearing Officer accepted during the hearing the following evidence: (1) Planning
Department Staff Report; (2) application, plans, maps and other supporting documents
submitted by the applicant and the applicant's representatives to the City of Fort Collins;
and (3) a tape recording of testimony provided during the hearing. The LUC, the City's
Comprehensive Plan (City Plan), and the formally promulgated policies of the City are
all considered part of the evidence considered by the Hearing Officer.

The Applicant has submitted a request to create a 2-lot subdivision plat for a 1.43-acre
property presently delineated by a metes and bounds legal description. A detached
single family house is presently located on proposed Lot 1. The project is located on the
south side of LaPorte Avenue between South Taft Hill Road and Briarwood Drive.
