Dear Mr. Wyatt Per our discussion with Mr. Glebe on February 2, 2005, the Condominium Declaration documentation required for the shared sanitary sewer service would need to be provided to the City of Fort Collins Utilities prior to final development approval. As for your letter, you indicated that at a future time you would need to determine the point of the ownership of the proposed sanitary sewer service. The following are exerts from Fort Collins Municipal Code and Chatter which clearly defines the point of responsibility for all salutary sewer services: - Sec. 26-206. Definitions ' Public sewer shall mean the sewer main or other major street sewer in which all owners of abutting properties have equal rights and which is part of the wastewater utility subject to the control and maintenance of the city. See. 26.206. Definitions Service line (private sewer) shall mean a sewer commencing at and collecting wastewater from a structure or facility on property served by the wastewater utility and ending at the public sewer where the wastewater is contributed to the wastewater utility. Sec. 26-257. Service lines; user responsibilities. (b) Maintenance. The owner shall be responsible for the cleaning; unstopping, maintenance and repair of the private sewer'and at self -expense shall keep the entire service line as well as all pipes, fixtures, appliances and apparatus on the property tight and in good workirig order to prevent discharge of combined wastewater or prohibited substances into the wastewater utility. The owner shall replace at the owner's expense any portion of the service line which in the opinion of the General Manager has become so damaged or disintegrated as to be unfit -for further use or is in such condition. as to permit infiltration into the public wastewater system. All repairs shall be completed within thirty (30) days after written notification from the utility. If the owner fails or refuses to complete repairs required by the General Manager,. the General Manager may cause the repairs to be completed and charge the owner for the costs of such repairs.
