C. The Homestead P.U.D. 2"d Filing, P.L.D. & P.D., Replat - PDP meets the plat
standards located in Section 3.3.1 - Plat Standards of Article 3 - General
Development Standards of the LUC.
RECOMMENDATION:
Staff recommends approval of the Homestead P.U.D. 2"d Filing, P.L.D. & P.D., Replat -
Project Development Plan - #32-03A

1) The subdivision plat will be filed and recorded only after having been
approved by the Director of Planning, with such approval evidenced in writing
on the plat and signed by the City Clerk.
2) No building permit or certificate of occupancy shall be issued for construction
of any new principal building or no act which changes the use of any building
shall be permitted until the subdivision plat is filed and recorded in the City of
Fort Collins.
B. The subdivision plat is in compliance with Section 3.3.1(B) Lots in that:
1) The lot has direct vehicular access to a public street (Hearthstone Drive). The
lot fronts on a public street (Hearthstone Drive). The side lot lines are
substantially at right angles or radial to the street lines.
2) The general layout of parcels, driveways, utilities, drainage facilities and other
services within the proposed Homestead P.U.D. 2"d Filing, P.L.D. & P.D.,
Replat - PDP have been previously established by other means.
C. The subdivision plat is in compliance with Section 3.3.1(C) Public Sites,
Reservations and Dedications in that:
1) An applicant shall be required to dedicate rights -of way for public streets,
drainage easements and utility easements as needed to serve the area being
platted. The right-of-way (ROW) for Hearthstone Drive was previously
dedicated by separate document and is being dedicated to the City of Fort
Collins with this replat. Additional ROW for this street is not required and is
not being dedicated with this replat. The drainage and utility easements
necessary to serve this lot are being dedicated to the City of Fort Collins with
the Homestead P.U.D. 2"d Filing, P.L.D. & P.D., Replat - PDP, if approved
and filed.
2) Reservation of sites for flood control, open space and other municipal uses
shall be made, as necessary, in accordance with the requirements of the
LUC.
5. Findings of Fact/Conclusion:
A. The Homestead P.U.D. 2"d Filing, P.L.D. & P.D., Replat - PDP contains a
permitted use in the LMN - Low Density Mixed -Use Neighborhood Zoning
District.
B. The Homestead P.U.D. 2"d Filing, P.L.D. & P.D., Replat - PDP meets the
procedural requirements located in Division 2.1 - General Procedural
Requirements, Division 2.2 - Common Development Review Procedures for
Homestead PUD 2"d Filing, PLD & PD, Project Development Plan, #32-03A

COMMENTS:
1. Background:
The surrounding zoning and land uses are as follows:
N: LMN in the City of Fort Collins; existing single-family residential (Homestead)
S: FA1 in Larimer County; existing school (Kinard Junior High)
W: FA1 in Larimer County; existing single-family residential (Homestead)
E: LMN in the City of Fort Collins; existing single-family residential (Homestead)
The property was subdivided and platted as Lot 10, Block 1 of the Homestead P.U.D.
2"d Filing, P.L.D. & P.D. in October, 2003, as approved by the Larimer County Board of
Commissioners.
This property was annexed into the City as part of the Homestead Annexation in March,
2004.
2. Purpose of the Subdivision:
The purpose for the replatting of Lot 10, Block 1 of the Homestead P.U.D. 2"d Filing,
P.L.D. & P.D. is to eliminate a "building envelope" on the previously platted lot. No
additional street right-of-way (ROW) is required or being dedicated with this replat. The
required utility & drainage and irrigation easements on the lot, as shown on the
previously approved & recorded plat, are being dedicated to the City of Fort Collins with
this replat. Staff has determined that there is no detriment to a development plan
associated with the replatting of the one lot.
3. Article 2 - Administration:
The Homestead P.U.D. 2"d Filing, P.L.D. & P.D., Replat - PDP complies with the
applicable requirements of the LUC, specifically the procedural requirements located in
Division 2.1 - General Procedural Requirements, Division 2.2 - Common Development
Review Procedures for Development Applications, and Section 2.4 - Project
Development Plan in Article 2 - Administration.
4. Article 3 - General Development Standards:
The Homestead P.U.D. 2"d Filing, P.L.D. & P.D., Replat - PDP complies with the
applicable requirements of the LUC, specifically the plat requirements located in
Section 3.3.1 - Plat Standards in Article 3 - General Development Standards.
A. The subdivision plat is in compliance with Section 3.3.1(A) General Provisions

PROJECT DESCRIPTION:
This is a proposal to replat a property known as Lot 10, Block 1 of the Homestead
P.U.D. 2"d Filing, P.L.D. & P.D. for the purpose of eliminating the currently platted
"building envelope" for a new single-family residence on the property. The property is at
2950 Hearthstone Drive and is in the LMN - Low Density Mixed -Use Neighborhood
District in the City of Fort Collins. The future structure(s) will be subject to the setback
requirements set forth in this District.
RECOMMENDATION: Approval
EXECUTIVE SUMMARY:
This request is to replat a property known as Lot 10, Block 1 of the Homestead P.U.D.
2"d Filing, P.L.D. & P.D. The request complies with the applicable requirements of the
Land Use Code (LUC), specifically the procedural requirements located in Division 2.1 -
