There may be system modification charges associated with development on this property and these charges will be at the property owner's expense. This completes staff (and outside reviewing agencies) review and comments at this time. Additional comments and red -lined plans may be forthcoming. Another round of staff review is determined to be necessary to enable City staff to receive and review utility plans. This proposal is subject to the 90-day revision re -submittal requirement (from the date of this comment letter, being December 3, 2003) as set forth in Section 2.2.11(A) of the Land Use Code. The alley will have to be designed and constructed if more than one dwelling unit takes access off of it. The current sidewalk along Elm Street does not meet standards, so each lot would be responsible for constructing a sidewalk to standards as it develops. As noted on the plat, some vacation of ROW on West Street has already occurred, and the question of vacating more ROW was raised. if further ROW vacation proposed by this development, then a formal request for that vacation will need to be submitted to the City and routed to all affected parties. The only ROW the City sees as a possibility for further vacation is the triangular portion adjacent to this replat, but this is a preliminary assessment and would, again, need to be routed to and approved by all affected parties (utilities, City departments, neighbors) and would also need to be approved by City Council. The instructions for requesting ROW vacation are attached.
