Subject: First MainStreet Bank status
Hello all,
I thought I'd send an email out regarding the status of First MainStreet Bank just to be sure that everyone
is on the same page with regards to the City's approval and permitting process. Also, I'll be out of the
office next week and wanted to make mention of this should activity pick up for the completion of the final
approval and the issuance of a construction permit.
A DCP meeting was held on 10/13 and it appeared that there was a desire to start construction as soon as
possible for getting the buildings up, as well as getting work in before the asphalt plants shut down. I have
not heard of anything since that time in order for us to complete the final compliance process through
Planning and issue a construction permit through Engineering. Thus no construction work is allowed at
this time and the project from a planning process is not considered complete.
The following items are outstanding in order to complete the aforementioned City processes:
- The development agreement signed by the owner(s) is needed to be returned to me in order for me to
circulate internally and give the go ahead to Steve Olt to file the planning documents. I was given a call
last week from someone in Dick's office asking if I had seen these and indicated that I have not seen
these (since sending them out to Dick on 10/4).
- A letter of credit for the public infrastructure costs in the amount of $159,421.64 is required by
Engineering before a DCP will be issued.
- An inspection check in the amount of $7,248.44 is required by Engineering before a DCP will be issued.
- An erosion control deposit paid to the Stormwater department is required, with a copy of the receipt of
this presented to Engineering before a DCP will be issued.
If there are issues from the owner/developer end on completing these tasks or on the project in general,
that's certainly not my place to get involved in and this email isn't intended to imply anything critical with
regards to the progress of the project in the past few weeks, it is what it is. My intention of this email is
just to be sure everyone is on the same page with where things are at currently and to perhaps request
some advance notice if things start moving in such a way that a rush to complete the City approvals is
requested to occur around next week while I'm away.

Marc,
Thanks for your status report. Due to some concerns expressed by my Board
of Directors, I have not been given final authority to file the Development
Agreement and begin construction. The concerns are not with the City of
Fort Collins but are internal in nature. I am working to overcome the
concerns expressed, and will present our Development Agreement, Letter of
Credit, fees and deposits as soon as I am given the go-ahead. I will let
everyone know as soon as I receive the authority to move forward.
