City staff reviewed this application, discussed it at staff review on December 8, 2004. A comment letter dated December 14, 2004 was sent to you, DMW Engineers, and King Surveyors. In the next to last paragraph of this letter it states, in part, that: This proposal is subject to the 90-day revision re -submittal requirement (from the date of this comment letter, being December 14, 2004) as set forth in Section 2.2.11(A) of the Land Use Code. Therefore, it is my opinion that a re -submittal must be made or an extension request must be addressed and submitted to Cameron, either as soon as possible. Also, after talking to Cameron, it sounds like I don't need an extension letter because we haven't submitted for final compliance yet, so 2.2.11(A) doesn't apply, because there's nothing technically under review. He clarified that at this point, until we submit our final compliance application, the section 2.2.11(C) applies. It verifies the fact that you did submit Final Compliance documentation for this development request on November 10, 2004. After completing the first round of development review a letter, dated December 14, 2004, with staff's concerns and comments was sent to you. At the end of this letter it stated that this Final Compliance review was subject to the 90-day revision re -submittal requirement set forth in Section 2.2.11(A) of the Land Use Code. At this time we are past the 90-day requirement. To date we have not received a re -submittal of the Adrian Subdivision, First Filing - Final Compliance documentation. Also, I am not aware of a request for an extension, as allowed per Section 2.2.11(A) of the Land Use Code, having been submitted. To ensure that the review and approval of this development plan is being diligently pursued and processed you must re -submit plans or submit a request for an extension no later than Friday, May 6, 2005.
