Please see the attached pdf file for a proposed variance request to
reduce the provided utility easement for an existing alley from 8' to 4'
as required under City of Fort Collins standards. This request is in
conjunction with a development proposal on 300 Smith Street, also known
as Old Town Commons. A response from your utility is requested to
verify whether the request is acceptable (response via email is fine).
If a response is not received by February 3, no objection to the
proposed variance request is assumed. (City Light and Power has already
indicated no objection.)

Nick and Rosita,
I believe you were cc'd on Xcel's response to the variance request. I
am reading Len's response as saying the variance is acceptable subject
to calling in locates to verify that existing gas lines aren't within
the area that would otherwise have been a utility easement. I would ask
that this be followed -up for verification, as I'm viewing Xcel's
response as officially "no approval" until Len states otherwise.

Public Service Co. does not have any facilities located in the area of
the requested variance according to our office records. Party will still
need to call for locates to verify that no gas distribution or lines are
present. After confirmation of no facilities, we have no objection to
the variance changing the u.e. from 8' to 4'. Len Hilderbrand
