Request for Variance
Mr. Virata,
This letter is in regards to the Old Town Commons project, and in particular, to request a
variance on the utility easement adjacent to the alley. The owner and applicant for this project
is Mrs. Rosita Bachmann. The Larimer County Urban Area Street Standards (LCUASS) have
been referenced in this letter. Specifically, a variance is being. requested from Figure 7-12F for
the typical section of an Alley Option 'B' (Drainage to One Side).
The alley is located at the rear of the subject property at 300 Smith Street. The alley intersects
Olive Street, and is bordered along the eastern edge by Import Auto Body. 20-ft of publicly
dedicated right-of-way is already in place for this alley. The existing gravel surface will be
paved and receive driveover curb and gutter as part of this development, in accordance with
Figure 7-12F. While the LCUASS Design Figure specifies an 8-ft utility easement width, we are
proposing a variance to allow a 4-ft easement width.
A utility coordination meeting was held for this project on November 19, 2004 at the City's 281
North College Avenue facility. At that.time, there were no objections to potentially reducing the,
standard easement widths along the site's perimeter. Comcast is the only utility provider (to our
knowledge) that needs to.run new facilities along the west side of the alley. For that reason,
Dennis Greenwalt of Comcast was contacted directly. Mr. Greenwalt was amiable to the
proposal of a 6-ft utility easement along Smith Street, a 4-ft utility easement along Olive Street,
and a 4-ft utility easement along the alley. He also indicated that additional pocket, easements
along Olive Street might be needed during final design once facilities and appurtenances are
located.
We feel justified in. requesting the variance listed above. Reducing the easement width allows
for a much better site plan design, while still meeting the needs of the utility providers. This
variance will not be detrimental to the public health, safety or welfare, nor should it pose
increased maintenance costs to the City of Fort Collins or any franchised utility company.
