SUMMARY OF CONCLUSIONS
A. The City of Fort Collins Southwest Water Pump Station Project Development
Plan is subject to administrative review and the requirements of the Land Use
Code (LUC).
B. The City of Fort Collins Southwest Water Pump Station Project Development
Plan includes a permitted use within the POL zoning district.
C. The City of Fort Collins Southwest Water Pump Station Project Development
Plan complies with all applicable General Development Standards contained in
Article 3 of the Land Use Code.
nFCISION
The City of Fort Collins Southwest Water Pump Station Project Development Plan #40-
03, is hereby approved by the Hearing Officer without condition.
Dated this 5th day of February 2004, per authority granted by Sections
1.4.9(E) and 2.1 of the Land Use Code.

FACTS AND FINDINGS
The surrounding zoning and land uses are as follows:
N: POL — Existing Cottonwood Glen Park
E: RL — Existing Residential Subdivision (Quail Hollow)
S: POL — Existing Cottonwood Glen Park
W: POL — Pine Ridge Open Space/Natural Area
1. Compliance with Article 4 and the POL Zoning District Standards:
As a permitted use, the Project Development Plan complies with the applicable
requirements of Article 4 and the POL Zoning District. The Staff Report
summarizes the PDP's compliance and no specific evidence was presented to
contradict the statements and conclusion of the staff report concerning
compliance with Article 4.
2. Compliance with Article 3 of the Land Use Code — General Development
Standards
An issue raised by a representative of neighboring residents involved adverse
noise impacts. It was an expressed fear that the noise generated from the pump
facility could create adverse impact to the neighborhood as has been perceived
with the existing pump station. As part of the Applicant's submittal, noise
reduction measures were identified, including the type of pump used and the
building construction utilized. The new pump building will include solid block
walls, solid steel doors and a steel roof. In addition, ventilation louvers will be
outfitted with filters that will help to reduce noise and improve air quality. In
comparison with the existing pump station, the new station pumps will primarily
operate during daytime hours. Based on the building design and public testimony
provided at the hearing, the Hearing Officer is convinced that the applicable
noise standard will be met and that the applicant has included mitigation
measures to reduce noise impacts to a level beyond that required through the
City's Land Use Code.
The Project Development Plan complies with all applicable requirements of
Article 3 including the plat standards of Section 3.3.1. No evidence was
presented to contradict the statements and conclusion of the staff report
concerning compliance or to otherwise refute the compliance with Article 3.

The Hearing Officer, presiding pursuant to the Fort Collins Land Use Code, opened the
hearing at approximately 4:30 p.m. on January 29, 2004 in Conference Room A at 281
North College Avenue, Fort Collins, Colorado.
HEARING TESTIMONY, WRITTEN COMMENTS AND OTHER EVIDENCE:
The Hearing Officer accepted during the hearing the following evidence: (1) Planning
Department Staff Report; (2) application, plans, maps and other supporting documents
submitted by the applicant and the applicant's representatives to the City of Fort Collins;
(3) a sign up sheet of persons attending the hearing; and (4) a tape recording of
discussion at the hearing. The LUC, the City's Comprehensive Plan (City Plan), and the
formally promulgated policies of the City are all considered part of the evidence
considered by the Hearing Officer.

This is a request to construct a 987-sq. ft. building to house three water pumps serving
the southwest water distribution system. The building is located on the southwest
portion of the Cottonwood Glen Park south of the existing parking lot and the existing
irrigation pump house.
