* April 12, 2004 (the week of) - Steve Olt contacts the City Clerk's office and requests that the Prospect
East 4th Annexation & Zoning item be put on the discussion agenda because the property owner would be
there to talk to City Council.
* April 20, 2004 - After a short discussion by City Council and testimony from Dixie Gibbons, Council
voted to continue the item to May 4th.

Please provide the following response to Council questions raised during the April 20th City Council
discussion about the Prospect East 4th Annexation. Based on the testimony of the property owner's
representative, Dixie Gibbons, there was some question as to whether the owner was adequately notified
of the public hearings associated with the annexation.
The following sequence of events that occurred regarding the Prospect East 4th Annexation & Zoning:
* January 20, 2004 - The Annexation & Zoning (to the RC - River Conservation District) request was
initiated by the Current Planning Department following discussions with Dixie Gibbons about the City's
interest in initiating annexation of the property (a County enclave). Ms. Gibbons indicated her lack of
support for the annexation, and the possible impact that City regulations may have on the existing and
anticipated future use of her property.
* February 4, 2004 - City Planner Steve Olt forwarded a memo to City Hall identifying the Planning and
Zoning Board and City Council hearing schedule.
* February, 2004 Steve Olt has an extended telephone conversation with Dixie Gibbons. In this
conversation, Ms. Gibbons did not relay concerns about the annexation & zoning per se, but to the
clean-up work on her property that she was told she would have to do once annexed. The potential code
compliance issues were conveyed to her by the City staff (both Cameron Gloss, Current Planning Director
and Rich Kopp with the Streets Department ) about a year earlier.
* March 4, 2004 - The standard letter of notification for a Planning and Zoning Board public hearing was
sent out to affected property owners for the March 18, 2004 hearing. A letter was sent to Lucille Anderson
Land, the property owner. It was confirmed that Ms. Gibbons received this letter because it was reviewed
by staff the night of April 20th, after Council had continued the item to May 4th.
* March 10, 2004 - Ms. Gibbons contacted Steve Olt from Florida to inquire about the "Development
Proposal Under Review" sign that the Current Planning Department had put on her property. Mr. Olt
confirmed that the sign would be changed, if possible, to a "Rezoning" sign to more accurately reflect the
annexation process. During this conversation, Mr. Olt reiterated the upcoming public hearing dates. By the
end of this week (March 12th) the sign had been replaced on the property.
* March 18, 2004 - Planning and Zoning Board public hearing. No one representing the property owners
for the Prospect East 4th Annexation & Zoning request spoke nor were present at the hearing.
April 5, 2004 - Dixie Gibbons called the City to ask if the annexation action on her property was going to be
discussed at a public hearing on April 6th. Mr. Olt was on vacation; a staff member incorrectly stated that
the item was not scheduled for a public hearing until April 15th.
* April 6, 2004 - The Prospect East 4th Annexation & Zoning item was passed unanimously by City
Council on the consent agenda.
* April 8, 2004 - Ms. Gibbons left a message with Steve Olt regarding the status of the annexation.
* April 9, 2004 - Steve Olt discusses situation with Ms Gibbons. She was unhappy that she had been
misinformed about the April 6th Council meeting. She also indicated that she felt that the RC - River
Conservation Zone District was too restrictive and that it would have a very negative impact on her ability
to possibly sell the property in the future. During this conversation, Mr. Olt gave an overview of City staffs
