Re: Prospect East 41h Annexation & Zoning, being the property (21 acres in
size) at 2601 East Prospect Road.
Dear Dixie,
As you are aware, the City -initiated Prospect East 4th Annexation & Zoning
action was scheduled to be heard by City Council for second reading on April
20, 2004. After a brief discussion, Council voted to continue the item to their
Tuesday, May 4, 2004, public hearing. Council public hearings begin at 6:00
p.m., with the agenda containing up to 30 minutes of Citizen Participation and
minimal discussion of the Consent Items agenda before the Discussion Items
agenda begins. The Prospect East 4th Annexation & Zoning item is scheduled to
be second on the Discussion Item agenda. It should be heard about 7:00 p.m.;
however, I would advise you to be at the Council public hearing no later than
6:30 p.m.
The Prospect East 4th Annexation is an involuntary, enclave annexation for the
property because it has been completely surrounded by properties within the
City of Fort Collins limits for a period of just over 5 years (January, 1999). As
set forth in the Colorado Revised Statutes, when any unincorporated area is
entirely contained within the boundaries of a municipality, the governing body
may by ordinance annex such area into the municipality. Pursuant to the
Intergovernmental Agreements between the City and Larimer County, the City
agrees to pursue involuntary annexation of any parcel that becomes eligible for
involuntary annexation.
