Subject: Annexations for Tonight
We've got some confusion going regarding two items on the agenda tonight. See below for the two
questions and answers.
Item #20: Harmony Farms Second Enclave; involuntary annexation
The Harmony Farms Second Annexation is Item 20. 1 couldn't (at least not very easily) find how many
acres this involves. Could you get that number for me?
The Harmony Farms enclave area is 5 acres.
Item #23: Prospect East Enclave; involuntary annexation.
Since this is an involuntary annexation, I would like to know why it
wasn't voluntary, and if anyone objected? It would be good to have this
information included in the packet. [I believe this question referred to Item #23.]
The annexation in question is the Prospect East 4th Annexation that is scheduled to go to Council tonight
for initiating resolution.
This is an involuntary annexation of a 21 acre property that has been completely surrounded by City limits
for at least 3 years. This creates a defined enclave, which makes it eligible for involuntary annexation. The
Intergovernmental Agreements between the City and Larimer County states that ... "The City agrees to
pursue involuntary annexation of any parcel that becomes eligible for involuntary annexation."
The City has been in contact with the property owner of the Prospect East 4th Annexation property. She
does not necessarily want to be annexed at this time but is not in direct opposition to the annexation. The
property is currently being used for farming purposes (a calving operation). City staff is recommending that
the property be placed in the RC - River Conservation Zoning District. This District is somewhat restrictive
regarding permitted land uses in that it is designed for the conservation and protection of predominantly
undeveloped land in the Poudre Rvier corridor. However, the existing use of the property is permitted.
