B. The Upland's Prospect Business Park, Replat of Lot 5 of Block 2, Project
Development Plan complies with all applicable General Development Standards,
including the Plat Standards, contained in Article 3 of the Land Use Code.
DECISION
The Upland's Prospect Business Park, Replat of Lot 5 of Block 2, Project Development
Plan, #38-03, is hereby approved by the Hearing Officer without condition.
Dated this 6th day of January 2004, per authority granted by Sections
1.4.9(E) and 2.1 of the Land Use Code.

FACTS AND FINDINGS
1. Compatibility with Surrounding Uses:
The surrounding zoning and land uses are as follows:
N: I - Industrial; Great Western Railway's right-of-way and tracks;
POL — Public Open Lands; existing Knix Natural Area;
S: I - Industrial; Academy Court, existing industrial development within the
Upland's Prospect Business Park; Prospect Road
W: I - Industrial; Union Pacific Railway's right-of-way and tracks, industrial
development along Riverside Avenue, Riverside Avenue;
E: I - Industrial; Great Western Railway's right-of-way and tracks;
POL — Public Open Lands; existing King Fisher Point Natural Area, Timberline
Road;
The property was annexed as part of the Upland Annexation in April of 1984.
2. Compliance with Article 4 and the I Zoning District Standards:
The Land Use and Development Standards defined by Section 4.23 (D) and (E)
do not apply to the subdivision process.
3. Compliance with Article 3 of the Land Use Code — General Development
Standards
A. Section 3.3.1 [B] — Lots
The proposed lots comply with the design standards in that Lot 1 provides
vehicular access to a public street, and Lot 2 is accessible to the street through a
dedicated access easement, and the newly created lot line is substantially at a
right angle to the street.
B. Section 3.3.1 [C] (1) - Public Sites, Reservations, and Dedications
The plat includes dedication of public access, utility, and drainage easements
necessary to serve the subject property.
SUMMARY OF CONCLUSIONS
A. The Upland's Prospect Business Park, Replat of Lot 5 of Block 2 Project
Development Plan is subject to administrative review and the requirements of the
Land Use Code (LUC).

STAFF RECOMMENDATION: Approval
NOTICE OF PUBLIC HEARING: Evidence presented to the Hearing Officer established
no controversy or facts to refute that the hearing was
properly posted, legal notices mailed and notice
published.
The Hearing Officer, presiding pursuant to the Fort Collins Land Use Code, opened the
hearing at approximately 3:00 p.m. on January 5, 2004 in Conference Room A at 281 N.
College Avenue, Fort Collins, Colorado.
HEARING TESTIMONY, WRITTEN COMMENTS AND OTHER EVIDENCE:
The Hearing Officer accepted during the hearing the following evidence: (1) Planning
Department Staff Report; (2) application, plans, maps and other supporting documents
submitted by the applicant and the applicant's representatives to the City of Fort Collins;
and (3) a tape recording of testimony provided during the hearing. The LUC, the City's
Comprehensive Plan (City Plan), and the formally promulgated policies of the City are
all considered part of the evidence considered by the Hearing Officer.

The Applicant has submitted a request to subdivide the existing 7.05 acre lot 5 of the
Upland's Prospect Business Park into two separate lots, a 2.2-acre lot and a 4.85-acre
lot. The 2,2 acre lot will contain the existing building at 1101 Academy Court, and the
4.85 acre lot will contain the existing supply yard for that same address. The site is
located at the north end of Academy Court, which is one block east of Riverside
Avenue, just north of Prospect Road. The Union Pacific Railroad tracks abut the
property on the southwest, and the Great Western Railroad tracks abut the property on
the northeast.
