The existing standard requires the following: 3.5.2(D)(2) Setback from Non -arterial Streets. The minimum setback of every residential building and of every detached accessory building that is incidental to the residential building from any public street right of way other than an aerial street right-of-way shall be fifteen (15) feet. We request a reduction of 3' from the required 15' setback to a 12' setback, to best accommodate the courtyards of the two units facing Olive Street. The requested setback will provide a more ample private yard on the south side of the property as well as provide additional shield from Riverside traffic. The modification will also allow us to push the garages facing Olive Street further back so that they are less visible from the street. The unit facing Smith Street will continue to have an ample front porch in keeping with the profile of similar nearby homes. Our intent for this comer lot is to design a building structure that meets the ideals of the City's Comprehensive Plan and New Urban design concepts. We intend to design in styles that are compatible with the surrounding neighborhood structures. We believe that our proposed site plan will advance or protect the public interests and purposes of the standard for which the modification is requested, equally well or better than would the plan, which complies with the standard (Modification Review Procedures 2.8.2(H.1.)
