FINDINGS OF FACT/CONCLUSIONS
After reviewing the Evergreen Park, Block 4, Lot 13 - PDP, staff makes the following
findings of fact and conclusions:
1. The proposed land use is permitted in the I — Industrial Zoning District.
2. The Project Development Plan complies with all applicable district standards
of Section 4.23 of the Land Use Code, I — Industrial Zoning District.
3. The Project Development Plan complies with all applicable General
Development Standards contained in Article 3 of the Land Use Code.
RECOMMENDATION:
Staff recommends approval of the Evergreen Park, Block 4, Lot 13 - Project
Development Plan - #9-04.

An outside storage area, with a gravel surface, is proposed between the
building and the west property line. This area will be enclosed on the west,
north, and south sides by a 6' high solid wood fence for screening.
There will be 6 parking spaces along the east side of the drive on the east
side of the building. These spaces will be separated from the street
sidewalk along Blue spruce Drive by the detention and properly screened
with plant materials, satisfying the requirement set forth in Section
3.2.2(J).
There are 6' wide landscaped setback areas along the north and south
property lines adjacent to the on -site vehicular use areas, satisfying the
requirement set forth in Section 3.2.2(J).
A new 4.5' wide detached sidewalk is being constructed along the east
side of the property adjacent to Blue Spruce Drive.
B. Division 3.3, Engineering Standards
1. Section 3.3.5, Engineering Design Standards
The proposal complies with the design standards, requirements, and
specifications for the services as set forth in this section. The property was
previously platted and no changes to the subdivision plat are needed or
required with this request to bring the uses on the property into
compliance with City Code.
C. Division 3.5, Building Standards
One new 1-story building is being proposed, with a total of 13, 775 square
feet of leasable floor area. The intent is to divide the square footage into
14 units to be leased to small building trade vendors. The building footprint
would be 71'-10" x 194'-4", oriented west to east.
Total height for the building would be 24'-6" to the top of the peak of the
hipped roof, running west to east.
The primary building material is to be a painted CMU, with horizontal lap
siding on the gable ends. Roofing material is to be an asphalt shingle.

The property was annexed into the City in November, 1972 as part of the Pine
Tree Park Annexation.
The property was platted as Lot 13, Block 4 of Evergreen Park in 1973.
The property was platted as Lot 13, Block 4 of the Replat (NO. 1) of Evergreen
Park. This subdivision plat was approved by City Council in March, 1974.
2. Division 4.23 of the Land Use Code — Industrial District
The proposed light industrial & warehouse uses (rental space for small building
trade vendors) are permitted in the I - Industrial Zoning District subject to an
administrative review.
The PDP meets the applicable Land Use Standards and Development Standards
in the Industrial District .
3. Article 3 of the Land Use Code — General Development Standards
The PDP complies with all applicable General Development Standards, more
specifically as follows:
A. Division 3.2, Site Planning and Design Standards
1. Section 3.2.1, Landscaping and Tree Protection
This request satisfies the applicable requirements set forth in this section
of the LUC. A mix of deciduous and evergreen shrubs are being provided
along the base of the existing 8' high solid metal fence along the north and
east sides of the property adjacent to the streets. Street trees at a
spacing of 40' will be provided in a 5' wide parkway between back of curb
and 4.5' wide sidewalk along Blue Spruce Drive.
2. Section 3.2.2, Access, Circulation and Parking
This request satisfies the applicable requirements set forth in this section
of the LUC. The vehicular access to the site will be from Blue Spruce
Drive at the northeast corner of the property. There will be an asphalt drive
entirely around the building to provide access to the overhead doors for
the 14 lease units in the building.

• the standards located in Division 3.3 — Engineering Standards of ARTICLE 3 -
GENERAL DEVELOPMENT STANDARDS;
• the standards located in Division 3.5 - Building Standards of ARTICLE 3 -
GENERAL DEVELOPMENT STANDARDS; and,
• the standards located in Division 4.23 Industrial (1) of ARTICLE 4 —
DISTRICTS.
Light industrial & warehouse uses are permitted in the I — Industrial Zoning District,
subject to an administrative (Type 1) review.
The purpose of the Industrial District is:
"To provide a location for a variety of work processes and work places such as
manufacturing, warehousing and distributing, indoor and outdoor storage, and a
wide rarige of commercial and industrial operations. The Industrial District also
accommodates complementary and supporting uses such as convenience
shopping, child care centers and housing. While these Districts will be linked to
the City's transportation system for multiple modes of travel, some may
emphasize efficient commercial trucking and rail traffic as needed. Industrial and
manufacturing processes used in this District may, by necessity, be
characteristically incompatible with residential uses."
This proposal complies with the purpose of the I - District as it proposes light industrial &
warehouse uses (rental space for small building trade vendors) on a vacant property in
a developed industrial park.

PROJECT DESCRIPTION:
This is a request to build a 13,775 square foot building to be divided into 14 interior
bays, each with walk-in and overhead doors, with the intended uses being light
industrial & warehouse (rental space for small building trade vendors). The property is
at 1225 Blue Spruce Drive. The property is located on the west side of Blue Spruce
Drive approximately 350' north of Conifer Street and is in the I — Industrial Zoning
District.
RECOMMENDATION: Approval
