[5/12/041 Before the commencement of grading or other construction
on the development site, any prairie dogs inhabiting portions of the
site within the LOD shall be relocated or eradicated by the
developer using city -approved methods as set forth in Chapter 4 of
the City Code and, when applicable, using methods reviewed and
approved by the Colorado Division of Wildlife. LUC 3.4.1(N)(5)
If prairie dogs continue to relocate to the site during construction
activities barrier fences and additional prairie dog removal may be
required to minimize the conflict. LUC 3.4.1(F)(3)

Bank, to the north, regarding a shared access to their driveway and
parking area. This will have an effect on the landscaping along the
north property line in the 5' to 6' wide landscape setback on this
property.

Plan based on comments #102 and #103, above, and the lack of a
Lighting Photometric Plan, the development plans are in a condition
that enable City staff to schedule an administrative (Type I) public
hearing for the development proposal. We can discuss a date for the
public hearing when the City receives the necessary off -site slope
easement from the Food Bank, to the north, a revised Landscape Plan,
and a Photometric Plan that satisfy all the applicable requirements
and standards in the Land Use Code.

benefit for their signature on the plans. A letter if intent was
not received and still required prior to a hearing.
[3/15/041 The owner of the transmission line easement will need to
provide a letter of intent agreeing in principle to the development
proposal. In general, having the driveway access within this
easement seems to be unusual, will the developer secure permanent
legal right for the operation of the driveway?

13 - PDP, and we offer the following comments:

(5/13/041 How is the required 20' wide emergency access easement,
as shown on the Site Plan, to be dedicated? A deed of dedication for
this easement is needed and has not yet been provided. A Site Plan
cannot dedicate easements and right-of-way.

[5/13/041 Why is no lighting plan / photometric being provided. One
has been asked for by City staff and the applicant's response to the
previous comment letter (comment 08 from Police) indicated that "the
owner is working on one".

[5/13/04] The revised Site Plan appears to be in a good condition
except for showing the complete alignment of the proposed new 6'
high wood fence along the property line at the northwest corner of
the site. The fence should continue east approximately 30' from the
last shown "x" and then turn south to end at the corner of the
asphalt drive (see red -lined Site Plan).

[5/13/041 There will have to be some revisions to the Landscape
Plan, partially based on the letter received from Carey Ashton of
the Department of Energy, Western Area Power Administration (WAPA).
Comment #5 in this letter says that "no plantings are allowed within
a 37.5 foot radius of power poles". There is an existing WAPA power
pole at the northeast corner of this site and the restriction would
eliminate all landscaping between the entry driveway and the north
property line for a distance of about 65' (see red -lined Landscape
Plan). I have tried to contact Ms. Ruthette Kennedy, as suggested,
but have not been successful in reaching her. It is important to
confirm that no landscaping can truly occur in this area.
