GRANT OF EASEMENT
THIS INDENTURE, made this day of , 2004, by and between the HOUSING
AUTHORITY OF THE CITY OF FORT COLLINS as party of the first part, hereinafter referred to as
"Grantor", and the CITY OF FORT COLLINS, COLORADO, a municipal corporation, hereinafter
referred to as "City."
WITNESSETH:
FOR GOOD AND VALUABLE CONSIDERATION, the receipt of which is hereby
acknowledged, Grantor has this day bargained and sold, and by these presents does bargain, sell, convey,
transfer and deliver unto the City, its successors and assigns, an exclusive easement in, over, and across
the real estate hereinafter described, including the perpetual right to enter upon said property at a time that
it may see fit, and to construct City owned utility systems across, through, upon and under the real
property hereinafter described and to repair, replace, relocate, inspect, operate and maintain said utility
systems; provided, however, that the City shall restore the ground surface to its prior condition after
disturbing same. The term "City owned utility systems," as used herein, shall include above and below
ground wires, lines, cables, ducts, pipes, pedestals, risers, poles, vaults, manholes and other equipment,
appurtenances and structures associated with Electric, Water and Sanitary Sewer purposes and which are
owned and operated by the City. The term "exclusive easement," as used herein, shall mean, that, any
above or below ground utility systems and appurtenances and other above or below ground permanent or
substantial structures not owned and maintained by the City shall not be installed or encroach upon any
portion of the herein described easement unless first approved otherwise by the City.
The easement and right-of-way hereby granted, situated in Larimer County, Colorado is described
as follows:

The Grantor does hereby covenant with the City that it is lawfully seized and possessed of the real

Sewer Line Easement at 1206 Montgomery St.
Dave Phillips from Premier Custom Builders is constructing a new building in the vacant lot adjacent to our
1206 Montgomery 4 plex. Dave has requested that we grant him a utility easement across our parking lot to
tie into the manhole of the sanitary sewer line.
It is the intention of the Fort Collins Housing Authority to grant Mr. Phillips this easement with the
understanding that he will repair all damages to our asphalt parking lot and reseal the entire lot once the
work has been completed.

proposed use. In this case the use is a 4 plex. Even though they may be sold as condos, the
building is classified by the LUC and the Building code as a multi family dwelling. "

plan indicates that 8 parking spaces are provided. However, I count only 4 legal spaces. I
assume they are counting the driveway behind the garage as a parking space. However,
Section 3.2.2(D)(2), each parking space has to have unobstructed access to the street. In
other words, tandem parking (one space behind another) is not allowed. Therefore, they
only have 4 parking spaces. "

R. Acknowledged: We intend that where wattles are placed on hard surfaces they will be
held in place with rock. For clarity, we added a note to the wattle detail in the plan
set.
`2. Your escrow calculations contain a $655/acre revegetation cost. The new cost to the
City to do this work is now $775/acre for areas less than 5 acres, and $725/acre for
more than 5 acres. Please use these figures on this and future projects.'

Stormwater Utility Issue Contact: Wes LamarQue

32. "Created: 03119104. The detention pond requires one foot of freeboard, which is not
provided. Due to this site being at the lower end of the basin, a higher release rate could be
used. Please increase the release rate of the pond until the one foot of freeboard is
accomplished. This will result in an orifice for the outfall some where between 6 and 12
inches, which is the outlet pipe size. This can be done only if the release rate from the pond
is not increased from existing conditions. Please call Wes Lamarque at 416-2418 if you
have any question. "
R. Acknowledged: The release orifice has been increased to 8 3/8" to allow 1.00 ft freeboard
for the detention pond.
33. "Created: 03119104. The 35 foot drainage easement in front of the property needs to
remain for possible future drainage improvements. Site improvements can be built over the
easement as long as no structures are in the easement. "
R. Acknowledged: The driveways that will be built will not inhibit the possibility of placing a
2'xW box culvert that will have the capacity of the 35' trapezoidal channel. Please see
Sheet 6 for further detail.
34. "Created: 03119104. Please use the actual C factors for the lots that are not developed to
the north and drain to the detention pond. These can be obtained from the previously
approved project's drainage plan. Also, the proposed grading for these lots needs to be
followed as well to determine the exact contributive area of these lots that were planned to
drain to the detention pond in the developed condition. "
R. Please note that 2-year runoff coefficient for the lots to the north that are not developed was
estimated to be 0.85, which in the 100-year condition, exceeds 1.00. Therefore, the runoff
coefficient for the lots to north will be sufficient for any future development in these lots.
Text has been added to this effect in drainage report in Section IV.C.3.

This letter provides responses to review comments concerning Staff Project Review for Eastgate
2"d Filing dated March 22, 2004. The Final Utility Plans, Final Plat, and Final Drainage and
Erosion Control Report redlines have been addressed with this resubmittal. The responses follow
the numbering order presented in the summaries.

26. "Created: 0311612004. The building design does not meet the design standards in Section
3.5.2(E)(])-Garage door setback from the building. This section requires street facing
garage doors to be setback 4 feet behind either the face of the house or front porch. "
R. Acknowledged: The garage is now 4 feet behind the front porch.
"As an alternative design approach, vehicle access could be taken from the adjacent
access drive west of the site, with the garages placed in the rear of the building. This would
also limit crossing the drainage easement along Montgomery Street with vehicle
driveways. "
