Indeed it is difficult to fathom how the Planning and Zoning Board can evaluate whether a modification of standards is in the public good for this project without any knowledge of the extent to which such a variance might impact any historical value of the existing structures. Failure to Consider Important Aspects of the Project. Finally, by his own admission Mr. Torgerson, Menning's architect, has completely failed to consider any design elements to mitigate the noise of a 20 car parking lot encircled by residential development. The significant negative impacts of such a parking lot could be largely mitigated by simply developing an underground structure to serve the proposed development. This would no doubt assuage the most immediate concerns of the nearest neighbors. However, the hurried and haphazard manner in which approvals and entitlements for this project seem to have been sought appears to have precluded such simple, common sense approaches to neighborhood concerns. I would like to thank you for the continuing opportunity to comment on this project as it proceeds through the planning process. I look forward to reaching a satisfactory conclusion to this process for all concerned parties, but am mindful that intelligent planning, innovative architecture and neighborhood accommodation cannot occur when projects are pursued in a reckless and headlong manner, to the exclusion of carefully tailored public processes. Reeves 810 Maple St. Fort Collins, CO 80521 • Page 2 May 25, 2004 Secondly, notice of the public meeting was provided only in the English language despite it being well known in the neighborhood that the.majority of the residents living directly east of the proposed project site are native Spanish speakers. These Spanish speaking Fort Collins residents will be most directly affected by the parking features of this project, with a 20-car parking lot planned in close proximity to the children's playground for their housing complex. Basic notions of fair play and due process demand that these non-English speaking citizens be offered an opportunity to comment on the project in their native language. Nearby peer communities (such as Longmont) currently conduct the development proposal review process in both English and Spanish. I believe it is incumbent upon the planning department to rectify these serious deficiencies by providing actual, accurate notice of the proposed development and an opportunity for all parties to be heard. At a minimum, this remedy should include a supplemental mailing noting the deficiencies in the original notice and offering affected parties a supplemental opportunity to file written comments. The Planning Department Should Not Advance Speculative Proposals in Advance of Compliance with Procedural Prerequisites. In an apparent attempt to curry favor with the neighborhood, Mr. Menning has puffed this project as a "high end", "paradigm shifting" development of $325,000 units. Although the current Fort Collins real estate market doesn't appear to support such an enthusiastic assessment of the profit potential of the completed project, such hopeful rhetoric is characteristic of Menning's haste to leap frog the planning process and rush to his bottom line before securing the necessary land use entitlements. As the planning department is well aware, several months ago Menning sought to have the alley abutting the proposed project site and intersecting Wood Street, vacated on the assumption that his project would be approved. Currently Menning has related that he will seek a modification of standards pursuant to Division 2.8 of the Fort Collins Land Use Code to allow the construction of otherwise prohibited three story structures. However, by his own admission, he has not yet received historical clearances for demolition at the site as required by City Code § § 14-71 and 14-72. I think it is undisputed that such historical clearances will be necessary given that the structure at 316 Wood is known to be at least 50 years old. Moreover, it is thought that this was the house of J. S. Turner, who is believed to have been the first African -American to have been issued a chauffeur's license in the State of Colorado. Because of its association with Mr. Turner, the property may be "associated with the lives of persons significant in history" under City Code § 14-5(2) or may also be associated with events that have made a significant contribution to the broad historical pattern of African -American social and economic integration into the mainstream of American life in Colorado. E.g. the River Rock Development at Martinez Park (suggested by Menning as comparable for appraisal purposes) shows that it may require approximately double the square footage, and 4 times the number of bedrooms, plus an arguably more desirable location, to achieve an asking price in the $300-$325K range. See Attachment B. In order for the neighborhood to realistically evaluate the potential impact a forthright appraisal of the actual probable sales prices is imperative. Patrick A. Introduction I own property and reside at 810 Maple Street (Parcel No. 27003) which will be impacted by the proposal to construct a multi -unit apartment/condominium project to be known as the "Wood Street Lofts." As more fully detailed below, I am concerned that this project is being pursued by the developer, George Menning, on an expedited basis with scant attention to the desires of the neighborhood as well as the legal prerequisites for development of such a high density project in the City of Fort Collins. Failure to Provide Adequate Notice of the Proposed Development The required notice of the public meeting to discuss the proposed Wood Street Lofts project that was mailed to affected residents and property owners failed to adequately disclose the intensity of the contemplated development. As presented at the public meeting held on May 12, 2004, the Wood Street Lofts project would replace 2 existing single family homes with 12 new dwelling units in three new structures —a six -fold increase in the number of dwelling units and a 50% increase in existing structures. However, the notice and accompanying map mailed to affected neighbors erroneously showed the area of the proposed development as encompassing 3 existing single family homes. See Attachment A. It is clear that in preparing the map accompanying the notice, the planning department conflated numbered parcels and platted lots thereby causing an unacceptable minimization of the impact of the proposed development. When in fact there were three affected platted lots and two affected parcels, the map showed three affected parcels. Therefore, anyone relying on the mailed notice would have concluded that the proposal would result in no net increase in structures with only a four- fold increase in units.
