Policy GM-2.1 Annexation Policies. The City Council will weigh the following factors when considerinz the annexation of new land into the incorporated limits: Statutory requirements. The property must meet all statutory requirements for annexation according to the laws of the State of Colorado. Property to be annexed located within the Community Growth Mana_,ement Area. The property must be currently located within the Community Growth Management Area boundary, or the boundary must be amended by actions ofthe City (and County, if necessary) before the City appro\ es the proposed annexation. — Phasinu, ot'public services and facilities. Vacant/undeveloped land proposed tier annexation must conform to the City's phasing requirements for extension of public services and facilities before being annexed. Infrastructure standards. Developed land, or areas seeking voluntary annexation. must have their infrastructure improved to City standards, or must have a mechanism in place to upgrade such services and facilities to City standards before the CitN %N ill assume full responsibility for future maintenance. Properties with annexation agreements as conditions of approval. Developments approved by the County that have an annexation agreement as a condition of approval, or have an annexation agreement with the City as a result of receiving out -of -city utility service, will be considered for annexation when they meet all statutory requirements. November 1. 2003 Cameron Gloss Director of Current Planning City of Fort Collins 281 North College Fort Collins, CO Dear Mr. Gloss: I am writing on behalf of my clients, John and Julie Adrian who are the owners of the subject property, to petition the annexation of their property into the city of Fort Collins. Per state law, we feel that this annexation meets the requirements of the Colorado Annexation Act for the following reasons: 1. This property has more than one -sixth of the perimeter of the area proposed to be annexed is contiguous with the city of Fort Collins. 2. We also feel that given the fact that this property lies within the City of Fort Collins adopted Urban Growth Area, a community of interest exists between the area proposed to be annexed and Fort Collins and that this area is urban and is integrated with the City of Fort Collins. We also contend that it is necessary and desirable for the City of Fort Collins to annex this area since the property will soon become the subject of a minor development, and per the intergovernmental agreement with Larimer County, it must seek annexation before any redevelopment proposal is proposed. We are seeking the LMN zoning classification, which is consistent with the currently adopted structure plan. This annexation is consistent with the following City Plan Principles and Policies: PRINCIPLE 1.1 -1: Growth within the city will promote a compact development h,ii icrn within a well-defined boundary.
