landscape will do nothing but enhance the existing conditions.

Dear Ted,
The Everitt Companies, owners of Everitt Mid -Town Plaza, located at 3000 and 3030
South College Avenue would like tp request a Modification of Standard 3.5.1(I) of the
Fort Collins Land Use Code (L.U.C.). This standard states "No areas for outdoor storage,
trash collection or compaction, loading or other such uses shall be located within twenty
(20) feet of any public street, public sidewalk or internal pedestrian way. It is requested
that the standard be modified, for the subject property, to allow a new trash enclosure to
be located within ten (10) feet of a public sidewalk.
Trash enclosure facilities for the subject property are currently located at the two primary
entrance corners of the existing buildings. These enclosures are in a state of disrepair and
are a visual disappointment to all who enter the buildings. Therefore, it is proposed that
these enclosures be removed from there present locations and consolidated into one new
enclosure located along the east property line to make room for new visually enhanced
walkways to the building main entrances.
The new trash enclosure is proposed to be located within the existing parking lot, ten (10)
feet away from the adjacent public sidewalk attached to Remmington Street. The
enclosure will be constructed of brick to match the existing buildings in walls to the height
of six (6) feet and will be capped with a brick soldier course and pre -cast concrete cap.
Decorative steel gates will be utilized for accessing the dumpsters and a non -gated
"hidden" entry will be utilized to allow users to enter the enclosure yet maintain a visual
screen of the trash area. Furthermore extensive landscape will be added around'the
enclosure in.an area that currently has virtually no landscape.
It is proposed that the alternative solution will.meet argument 2.8.2(H)(1) of the L.U.C.
stating "the plan as submitted will promote the general purpose of the standard for which
the modification is requested equally well or better than would a plan which complies with
the standard for which a modification is requested". This argument is made based on the
fact that an alternative trash enclosure, meeting the requirements of the standard, could be
constructed of lesser materials with lesser landscape within the parking lot and yet be less
visually and functionally desirable from the perspective of the actual users within the site
and from the perspective of the pedestrians using the sidewalk and the drivers passing, by
