Unless the applicant has made some arrangements with us that one component, e.g.- a TIS where Eric Bracke has given his ok that it can be submitted a week late, or a component officially "waived", the application should not be routed until we have a complete application. Since I don't recall any blessing we gave this applicant about a tardy submittal fee or a waiver, we should not have accepted the application. All of that being said, we did accept the application and routed it. The City operated in good faith, but the applicant failed to meet their requirements. The application has expired. Now the question remains on whether they need to go back through the neighborhood meeting process. I would argue that this project is a Type II review and may have "significant neighborhood impacts", therefore they need to conduct another neighborhood meeting. So is it expired or not? The lawyer who is on retainer by the neighborhood thinks that this project should go through the steps again including the Neighborhood Meeting. A Neighborhood Meeting was held May 12, 2004. 1 tend to agree with him since it's been months since anything has happened. Projects are supposed to be pursued diligently, but if payment was never accepted, that confuses the issue. Thoughts? Anne
