Anne,
A plat will be necessary, showing a utility easement along the northerly side of lot #2 for the existing
underground electric facilities. In order for me to okay a plat, one of the following will need to take place.
This was included in my DMx comments on 6-29-04:
1. Make the easement wide enough to encompass the existing electric facilities (Ed would need to
have the electric line physically located by the Utility system locators, then adjust the easement width if
necessary).
OR
2. Agree to pay the costs to relocate the existing electric facilities into the 5 ft. easement shown on the
latest preliminary plat that I have (dated 6-17-04).

Hi all.
Had a couple of calls from Ed Zdenek re: the above. Wanted to run it by you all to make sure I've got it
right and that we're all on the same page.
He is wanting to sell Lot 1 and possibly Lot 2 to Robin Bachelet. Lot 1 is still slated to be the mixed -use
project that came through conceptual. If Robin buys Lot 2 it may not become Oil Can Henry's. They are
in real estate negotiations now, and Ed wants to structure the deal so that the lots sell separately. If Robin
does not buy Lot 2, it may still become Oil Can Henry's.
He wanted to know what he needed to do to get the plat approved so it could be filed and the real estate
transaction can proceed. I read the conditional approval from the admin. hearing and the only condition is
that the access easements be shown on the plat. However, we've had a few staff meetings about it since
and I believe we decided that Ed needed to submit some sort of utility plans too including existing utilities,
utility easements and the access easement for Lot 2 and that the utility plans must match. I left Ed a
message to this effect.
I've since looked deeper into the file and see that Cameron suggested that to meet 3.3.1 (13)(2) he'd either
need a full set of utility plans or a stamped schematic from their engineer stating that they can make the
sewer work.
Since Lot 2 may be up in the air, I'm concerned about how this is handled. Please let me know if there's
anything else I'm -missing.
