3. When developing your plans, pay particular attention to the following

• 3.4.5 Hazardous Materials
• 3.5.3 Mixed -use Institutional and Commercial Buildings
(from the color perspective drawing, it looks like you've done
a great job with this so far.)

4. When redesigning the site to meet the shared access requirement, keep in
mind that you need to provide a connecting walkway from City Park Avenue
to the door. A connecting walkway cannot intersect with vehicular traffic.
You may need to either provide a raised walkway across the drive aisle or
request a modification if you are unable to comply with this standard.
5. You will need to set up an appointment to submit your application with
Ginger Dodge in Current Planning at 221-6750. Incomplete submittals will
not be accepted.

Stormwater

1. This site is in the Old Town drainage basin where the new development fee
is $4,150.00/acre which is it is subject to the runoff coefficient reduction.
This fee is to be paid at the time the building permit is issued. This fee is
charged when there is an increase in imperviousness greater than 350
square feet. Since the site is already paved there should not be any fee.
2. A drainage and erosion control report and construction plans are required
and they must be prepared by a Professional Engineer registered in
Colorado. In the Old Town drainage basin these are required if there is an
increase in imperviousness greater than 5000 square feet. In this case,
even though there is not an increase in imperviousness, what is needed is a
letter report with a sketch that would document the existing drainage
patterns and flow rates as well as how the proposed site will drain and the
proposed flow rates if they are different.
3. The site imperviousness is "grandfathered" and, due to its location in the
drainage system, onsite water quantity detention is not required. However,
- water quality treatment is still required under state and local requirements.
To meet the water quality requirements, a structural treatment system, i.e. (a
Stormcetpor or similar device) could be used, or water quality extended
detention could be provided in the landscape areas on the site. Please
contact Kevin McBride (224-6023) for further discussions on how to meet
the water quality requirements. A grading plan is another primary
requirement needed by the Stormwater Utility.
4. Per the Brazil 2004 plat, the rear portion of Lot 2 is in the Canal Importation
100-year High Risk floodplain. Since a lube facility is considered a critical
facility, the structure must be completely out of the 100-year floodplain as
well as any accessory structure which might store hazardous material for
use by the lube shop. Any site work done in the floodplain will require a
floodplain use permit ($25 fee). Contact: Susan Hayes, 416-2233.
5. There is a storm sewer in Elizabeth Street if there is a need for a deeper
outfall.
Transportation Planning

1. Please provide a bike rack on the site, convenient to the door. This is
required even though this is a drive through establishment to accommodate
employees.
2. The sidewalk along City Park Ave. needs to be brought up to standards. An
attached sidewalk would be acceptable from my point of view, though an
engineering variance will be needed and other standards will need to be
met.
Current Planning

1. This development proposal is subject to all applicable standards of the Fort
Collins Land Use Code (LUC), including Article 3 General Development
Standards, and Division 4.14 Community Commercial District.

1. Street Oversizing Fees for this site will apply. Contact Matt Baker at (970)
224-6108 for an updated estimate of the fees for this kind of use.
2. A Traffic Impact Study will need to be submitted for this project. Contact Eric
Bracke at (970) 224-6062 for a scoping meeting.
3. Right -of way will need to be dedicated along City Park Avenue. The total
ROW for City Park Avenue is 76', of which you will need to dedicate 38' plus
a 9' utility easement.
4. Utility plans, a Development Agreement, a Development Construction Permit
and plat will need to be prepared for this project.
5. Any existing damaged curb, gutter or sidewalk will need to be repaired or
replaced.
6. Owner will be responsible for undergrounding any remaining overhead
utilities.
7. Any public improvements must be made according to Larimer County Urban
Area Street Standards..
8. This site will need to share Lot 1's access off City Park Avenue. We'll need
to have a utility and a 24' public access easement dedicated by the theater.
Easements or a letter of intent to that effect will be required before the
project goes to hearing.
9. The parking setback from City Park Ave. is 50'.
10. Show standard drive cut on City Park Ave. unless your total trips per day
exceed 350.
11. Wherever City standards are not able to be met, a variance will need to be
submitted.
12. Contact Ron Gonzales at the Poudre Fire Authority at 416-2864 for their
requirements before submitting your PDP.
13. Comments from the Brazil 2004 conceptual review and staff review apply.
14. Improvements to City Park Avenue along the property frontage to current
City standards are the developer's responsibility.
Light and Power

1. The existing service is located on the north side of the proposed Oil Can
Henry's. Please provide an easement for this line.
2. The transformer location will need to be coordinated between the applicant
and the City. It needs to be within 10' of pavement.
3. Electric capacity and building site charges apply to this project.
4. Please submit a commercial C-1 form.
5. Any system modifications or relocation will need to be done at the owner's
expense.
Water / Wastewater

1. There is an existing 8" sanitary sewer and 8" water main in Elizabeth St.
There is also a 1 W water main in City Park Avenue and an 8" sanitary sewer
West of City Park in an easement.
2. The wastewater drains for this project need to go through a sand and oil
interceptor.
3. Water conservation standards apply to this project.
4. Development fees and rights are due prior to receiving Building Permit.

Can Henry's on Lot 2 of Brazil 2004. The property is within the City of Fort Collins and
is currently zoned CC - Community Commercial. The following departmental agencies
have offered comments for this proposal.

Zoning

1. Vehicle Minor Repair is a permitted use in the CC District and would be
subject to a Type 2 (Planning and Zoning Board) review.
2. You will need to provide a van accessible parking space close to the
entrance on the southeast of the lot.
3. Please provide landscape plans when you submit the PDP application. The
parking lot needs to be 6% landscaped as described in 3.2.1(E)(5). Also
provide perimeter and foundation plantings.
4. Provide a trash enclosure and bike rack.
5. You will need to meet the build -to lines as described in 3.5.3 (B)(2).
6. This property is not in the Neighborhood Sign District and therefore, signs
will be subject to a separate permit process. Please do not indicate
proposed signage, beyond size and placement on plans.
