As our discussion with Helen indicated, the easements being granted by
the City (temporary construction easement, landscape easement, sidewalk
easement, Comcast and Excel easement) will not be granted by City
Council and recorded until approximately December 5th.
That is two months from today, and by that time the asphalt plant will
be closed.
Our goal is to try to find a solution that enables us to do the grading,
asphalt and concrete for this project while it is still possible before
cold weather sets in. Then we will be able to start vertical
construction, as weather permits during the winter months.
I realize we do not have a solution to this problem yet but again
appreciate you talking with Cameron, Anne and Helen to see if you can
come up with any good ideas.
If it would be valuable to schedule a meeting regarding this, let me
know.

I've done some further follow-up with City staff and have a potential solution to offer on Jon's Willow Street
Lofts project. The concern that has been brought up is having construction commence in advance of
items that are slated to go to City Council in November which deeds rights to the Willow Street Lofts
developer to build certain improvements within land currently owned by the City.
We're willing to allow the Willow Street Lofts project to proceed (assuming other conditions of entitlement
completion, DCP issuance, etc. are met) without having the Council items approved. This would be
predicated upon Jon providing in writing notice to the City that any effort on Jon's part to proceed without
the Council approvals would be fully at his own risk and the City would be under no obligation to accept
any non-compliance concerns that arise with his project should Council approval should not occur. In
addition, until Council approval occurs, no construction activities shall be allowed within the areas seeking
Council approval. Jon should be aware that minor and/or major amendments to his project may be
required as part of any redesign effort to address any concerns arising from a Council denial pertaining to
his project.
Let us know if Jon finds this amenable or has any further thoughts or concerns
