Subject: Hearing for Lemay Ave Estates
Steve, Doug, Marc,
We received the comments for Lemay Avenue Estates, and would like to
schedule the item and the modification for public hearing as soon as
possible. It is our understanding that there is a short punch list of
the issues that need to be resolved prior to scheduling for the hearing.
The punch list, as we understand it, includes the following:
1. The Stormwater Department agrees to accept ownership of the area
within the floodplain. Tract D includes this area but also some area
outside of the floodplain. We need to split Tract D into 2 separate
tracts, one within the floodplain, and one out of the floodplain.
2. Mountain Home Drive needs to be widened to 36' between Lemay Ave
and Showline Road.
3. Subdrains. We don't think we need any based on the soils
report. If it turns out we need subdrains, we are happy agreeing not to
outlet below the 100 floodplain line. We assume we can work this detail
out in the final compliance review.
4. We need a letter of intent from the property owner to for any
necessary easements. We talked to Sheri Wamhoff when Marc was on
vacation. We did research on the Greenstone easement. It turns out
that the easement was dedicated on the Greenstone plat by Mrs. Graese,
the previous property owner, and it was dedicated as a public easement,
which Sheri concurred means that the City of Fort Collins is the
recipient of the easement, and said that we don't therefore need a
letter of intent. The other potential easement issue is the driveway
serving the property to the south. Do you need any agreement from this
property owner prior to the hearing, or is it final compliance.
5. The bridges referred to in the comments regarding the sidewalks
on the entry street are actually not bridges, but rather arbors, that
the sidewalk goes underneath. We propose to take a plan A to hearing
without these arbors, and provided we can coordinate the issues on this
during final compliance, we'd like to proceed with the plan B of the
arbor.
