you can answer this question or not, but does the city
typically approve requests for modifications of lot
size standards or does it go case by case? Also, do
you know how much, if any, influence neighborhood input
has on that process?

Hi Denise,
I am writing you and Sue Taylor together since I got similar questions from you about 1310 Laporte (Sue,
your call to Cameron Gloss was forwarded to me).
First of all, I think it's great that you all are pulling together as a concerned neighborhood group. I imagine
you already know about the Neighborhood Services Department here in the City and have taken
advantage of the services they can offer to you as you organize your group. Once you have gotten
established, let me know who your contact person is and I can disseminate information to you all very
efficiently.
Now to your questions about the modification that is being requested for 1310 Laporte. I am your contact
person on the project. I'm the project planner and my role is to coordinate the whole process. I
coordinate internally with all the City departments that are involved in the process and externally with
citizens and the developers and their representatives.
This request for modification of minimum lot size will ultimately be heard by a hearing officer. We have a
few hearing officers internally and we also contract the services of a Denver law firm that specializes in
Land Use law. The officer for this hearing will be an attorney from the Denver firm. He or she receives
public input on the project in one of three ways: in1he form of a letter from a concerned citizen, an email
from a concerned citizen, either of which should be addressed to me, or via making comments at the
public hearing in person.
All written input that I receive goes into the public record and is copied to the hearing officer. The hearing
officer does read all documents in the file including citizen input.
Modifications are decided on a case by case basis. Decisions are based primarily on code compliance,
including, in the case of modifications, the criteria in Division 2.8.2(H)1,2,3 or 4 depending on what the
applicant requests. (This information is available on the web at:
http://www.colocode.com/ftcollins/landuse/beciin.htm ) The applicant has indicated to me that he will likely
use 2.8.2(H)(4) though I have not yet received a letter of request for the modification. Other factors in the
decision -making process include the staff recommendation in my staff report, the request letter from the
applicant and last but not least, citizen input.
I should tell you that in 1997, the city council changed it's development policy by switching from a point
system Land Development Guidance System (LDGS) to a Land Use Code (LUC). That happened largely
because of increasing fears about growth. It is a pretty good system but to be honest with you both,
neighborhood input carries less weight now than it did then. Development used to be much more
negotiable but also much more open-ended. Now development is much more regulated and proscribed,
but as a result, less flexible to input.
With that said though, I have seen many cases of strong neighborhood organization and involvement
having a very persuasive impact on proposed projects. You all are on the right path by organizing, getting
involved, asking questions, etc.
The modification process will commence once the applicant submits a letter of request. The applicant
must deal with that abandoned easement on the east end of the property first though, and that might take
a bit of time. Also, you should know that as it has been presented to me verbally by the applicant, I plan to
recommend denial of the request in my staff report. The hearing officer may decide what they want based
on the information they have on the project, but it would be unusual for them to completely ignore the staff
recommendation. The applicant is aware of this. The applicant could rethink their plan to one that meets
code, and that could change my recommendation even though the proposal might still be unacceptable to
