Staff has reviewed your submittal for the Northeast Corner of East
Prospect Road and I-25 Rezoning, and we offer the following comments:
ISSUES:

[7/ 19/071 Ken Waido, Advance Planning Department, offered the
following comments:
1. The rezoning petition itself, from the applicant, contains insufficient
justification for the rezoning. The applicant states the "capture of
important sales tax revenue" and references the "Regional Retail
Opportunity Study" (done by EPS) as the justifications for the request.
The applicant also states that City staff "will provide justification for
this rezoning request" which is not the role of staff.
2. There is no mention of the need to amend the City Structure Plan
map and the I-25 Subarea Plan to support the rezoning and/or a
change of conditions in the area as justifications for the rezoning. The
I-25 Subarea Plan identifies the Mulberry/I-25 interchange as the
appropriate location for a regional/community shopping center, not at
the Prospect interchange.
3. There is no discussion about the loss of industrial/employment zoned
land.
4. What does the EPS Study say about retail potential in the I-25
corridor?
Next steps: CP/CD staff needs to conduct additional meetings with the
applicant/property owners to discuss this rezoning request. Staff has
looked at combining this rezoning request with other zoning changes
around the I-25/Prospect interchange into a comprehensive rezoning to
include portions of the Resource Recovery Farm and CSU's visions for land
use.
