The Haas Subdivision Project Development Plan (PDP) meets the plat standards located in Section 3.3.1 - Plat Standards of Article 3 - General Development Standards of the Land Use Code (LUC). RECOMMENDATION: Staff recommends approval of the Haas Subdivision, Project Development Plan - #1- 05. ATTACHMENTS: Site plan and plat Vicinity Map Site Photos Haas Subdivision, Project Development Plan, #1-05 April 18, 2005 Administrative Hearing Page 3 The Haas Subdivision Project Development Plan (PDP) complies with the applicable requirements of the Land Use Code (LUC), specifically the plat requirements located in Section 3.3.1 - Plat Standards in Article 3 - General Development Standards. A. The subdivision plat is in compliance with Section 3.3.1(A) General Provisions in that: 1) The subdivision plat will be filed and recorded only after having been approved by the Director of Planning, with such approval evidenced in writing on the plat and signed by the City Clerk. 2) No building permit or certificate of occupancy shall be issued for construction of any new principal building or no act which changes the use of any building shall be permitted until the subdivision plat is filed and recorded in the City of Fort Collins. B. The subdivision plat is in compliance with Section 3.3.1(B) Lots in that: 1) The lots have direct vehicular access to public streets (South Taft Hill Road and Haas Lane). Lots 1 and 2 front on a public street (Taft Hill Road), and Lot 3 is accessed from an emergency access easement dedicated as Haas Lane. The north lot line for Lot 2 is at a right angle to the street line and then follows the Pleasant Valley and Lake Canal Ditch to the south. C. The subdivision plat is in compliance with Section 3.3.1(C) Public Sites, Reservations and Dedications in that: 1) An applicant shall be required to dedicate rights -of way for public streets, drainage easements and utility easements as needed to serve the area being platted. Right-of-way (ROW), drainage and utility easements necessary to serve these lots will be dedicated with the Haas Subdivision plat, if approved and filed. 5. Findings of Fact/Conclusion: A. The Haas Subdivision Project Development Plan (PDP) contains existing permitted uses in the LMN — Low Density Mixed -Use Neighborhood District. B. The Haas Subdivision Project Development Plan (PDP) meets the procedural requirements located in Division 2.1 - General Procedural Requirements, Division 2.2 - Common Development Review Procedures for Development Applications, and Section 2.4 - Project Development Plan in Article 2 - Administration of the Land Use Code (LUC). COMMENTS: 1. Background: The surrounding zoning and land uses are as follows: N: LMN in the City of Fort Collins; S: LMN in the City of Fort Collins; W: UE in the City of Fort Collins; E: LMN in the City of Fort Collins; 2. Purpose of the Subdivision: existing single-family residence existing single-family residence existing single-family residences and outbuildlings existing single-family residences and outbuildlings The purpose for the platting of the Haas Subdivision, Project Development Plan (PDP) is to create three legally subdivided lots, and dedicate street right-of-way (ROW) for Taft Hill Road on a property that presently has a metes & bounds legal description. The three -lot subdivision plat will create one lot that is 1.07 acres in size (Lot 1), a second lot that is 0.87 acres in size (Lot 2), a third lot that is 3.07 acres in size (Lot 3) and 1,277 sq. ft. (0.03 acres) of dedicated right-of-way (ROW) along Taft Hill Road. With this plat additional right-of-way has been dedicated along Haas Lane. An emergency access easement is dedicated to serve the existing Lot 3. Staff has determined that there is no detriment to a development plan associated with the platting of the three lots and dedication of right-of-way (ROW) as proposed. 3. Article 2 - Administration: The Haas Subdivision, PDP complies with the applicable requirements of the Land Use Code (LUC), specifically the procedural requirements located in Division 2.1 - General Procedural Requirements, Division 2.2 - Common Development Review Procedures for Development Applications, and Section 2.4 - Project Development Plan in Article 2 - Administration. 4. Haas 1994 Kinnison Dr. Fort Collins, CO 80526 PROJECT DESCRIPTION: This is a request to create a 3-lot subdivision plat for a 5.01 acre property that has a metes & bounds legal description. The property currently contains two (2) residential dwelling units, two (2) storage sheds, five (5) outbuildings used for storage, a poultry brooding shed, a small tree farm, RV parking space, and a portion of the Pleasant Valley and Lake Canal. No new development is being proposed at this time with the subdivision of the land. The property is located at 3000 South Taft Hill Road (south of Drake Road on the east side of Taft Hill Road). The property is within the City of Fort Collins and zoned LMN, Low Density Mixed -Use Neighborhood.
