BACKGROUND Section 2.8.2 (K) of the Land Use Code, identifies Modification Review Procedures pertaining to Lapse Provisions. Section (K) pertains to an initial submittal of a development plan in accordance with the provisions of Section 2.2.1 shall be valid for a period of time not to exceed one (1) year following the determination of the decision maker on the request for the proposed modification. However, the Land Use Code modification review process does not address multiple phases. An interpretation request has been received regarding clarification of the applicability of the modification extending through Phase II of the project development plan. While the applicant is preparing for submittal of a PDP for Phase I within the required time frame, it may be several years before Phase II PDP is submitted and are seeking assurance the modification is still valid ten years or more out in the future. The request for a modification of standard for a future PDP identified 35 % to be developed as secondary uses versus the standard 25%. This Modification to Section 4.21 (D) (2) was approved by the Planning and Zoning Board on February 17, 2005 with the condition that the secondary uses are limited to places of worship or assembly and child care, the allowable accessory uses typically associated with supporting such secondary uses. In this particular case the applicant has indicated that the future PDP will include an expansion of the existing place of worship, private school and the allowable accessory uses. 281 North College Avenue • P.O.
