We'll allow the letter to serve as a letter of intent. I will recommend to Anne that a condition be placed on
the project requiring the obtaining of full approval of the railroad prior to the approval of a final plan.

Marc,
One of the things on our punch list of items needing to be resolved prior to
hearing is the "letter of intent" of the railroad boring. It's my
understanding that Dave Holloway has had several conversations with you last
week about this issue. It's my understanding that you already have the
document that I am enclosing in this e-mail, however, just in case you
haven't recieved it already, you will now have it. This document is a
signed letter with attached draft agreement on the details of the boring.
It basically says that if we pay the appropriate fees and get the
appropriate insurance, the BNSF intends to work dilligently with us on
allowing us to bore under the tracks. The pdf file includes a 15 page draft
of a license agreement specific for our request. It seems that this should
serve the purpose of a letter of intent. This attached file clarifies to me
that the railroad will let us bore so long as we work through the approvals
with them. The execution of the agreement between us and the railroad seems
at this point to be a final compliance issue. Can you confirm for me
whether or not this attached document will serve as the "letter of intent",
and if not, why not?
