Mason Street, Suite 5 Fort Collins, CO 80524 Re: J.D.: This letter is a follow-up to your December 8, 2004 phone call to me to discuss your intention to request a change to City's Harmony Corridor Plan with regard to permitted land uses for your property on the west side of Allegro Boulevard (the entrance to the Harmony Road Manufactured Home Community) at its intersection with Harmony Road. As we are both recent purchasers of the sites on the either side of the entrance to this manufactured home community, you and Jay Stoner purchasing the west 4.67 site and Imago Enterprises, Inc. the east 3.71 site, I appreciate your courtesy of informing me of your efforts with the City. I understand from our recent conversation and my two prior phone discussions with Jay that you will be submitting a formal request to the City to allow retail uses (either multiple or a single user) foryouur entire property. I believe you said that you would be requesting either a modification to the. Corridor Plan itself to allow a free-standing retail user and/or a modification to the limitation of 25 percent of the property for "secondary uses", as defined in the Corridor Plan: Whichever the case, while I support your right to expand the permitted uses for your property, Imago chooses to take a "wait and see" position regarding a land use change for its' property. As we both have seen, the City's vision for the Harmony Corridor is evolving, as evidenced by the major rezoning for a retail "lifestyle center" just east of my site. Perhaps, you may identify some policy basis or justifications for your desired land use changes that are convincing to the City. I would like you and the City to know that in the event some public interest basis for such a change is acknowledged by the City, that Imago intends to submit to the City a request for a similar change of land use for its' property. Our properties have nearly identical characteristics, that is, similar in size, located at the same intersection along Harmony Road, adjoining major retail centers, and so on. I would expect that any justification for a land use change for one property would apply to the other. Once you have resolved your issue with permitted land uses for your property, we can discuss the benefits of proceeding cooperatively with an Overall Development Plan including both properties and the redesign of the north side of the intersection.
