Article 3 of the Land Use Code — General Development Standards The existing building (Meldrum and Myrtle PDP #13-01) complies with applicable General Development Standards as it was built in 2001. There are no applicable standards in Article 3 for this current PDP for the change of use. 4. Findings of Fact/Conclusion: In evaluating the request for the change of use for 321 Myrtle from multi -family to a fraternity house, Staff makes the following findings of fact: A. The proposed land use is permitted in the (NCB) Neighborhood Conservation, Buffer District, subject to Planning & Zoning Board review; B. The existing building and the Project Development Plan (PDP) comply with applicable district standards of Section 4.8 of the Land Use Code, (NCB) Neighborhood Conservation, Buffer District; C. The existing building and Project Development Plan (PDP) comply with applicable General Development standards of Article 3 of the Land Use Code; and D. There was no opposition to the PDP expressed at the neighborhood meeting. RECOMMENDATION: Staff recommends approval of the change the use of an existing four-plex from multi family residential to fraternity for the Delta Chi Fraternity House, 321 W. Myrtle PDP Type 11 (#04-05). Background The surrounding zoning and land uses are as follows: N: D Existing Downtown single-family and multi -family residential and commercial space; E: CC Existing Community Commercial multi -family residential (CSU-owned residence halls); S: NCB Existing Neighborhood Conservation, Buffer District single-family residential with multi -family residential (CSU-owned residence halls) beyond; W: NCB Existing Neighborhood Conservation, Buffer District single-family residential. The existing multi -family building was approved as a Type I project in 2001 and built shortly thereafter as approved. This change of use PDP would normally trigger improvements to the building and site to bring it up to the current standards of the Land Use Code, but since the project was built so recently, it is already up to code. A member of the Building and Zoning Staff conducted a site visit in February of 2005 and ensured that the project was constructed as approved and that there are no subsequent changes that need to be addressed. The fraternity recently purchased and installed a bike rack on the site. 2. Division 4.8 of the Land Use Code (NCB)- Neighborhood Conservation, Buffer District The Project Development Plan meets the applicable Permitted Uses [4.8(8)] and Land Use Standards [4.8 (D)] as follows: A. Residential Uses: Fraternity Houses [4.8 (B)(3)(a)(1)] —This use is permitted, subject to Planning and Zoning Board review. B. Land Use Standards [4.8 (D)] —The existing building ( which was called "Meldrum and Myrtle PDP #13-01 ") conforms to the intent of the standards pertaining to density and dimensional standards as it was built in 2001. The only physical change that will occur to the site or building as a result of this PDP will be the addition of a modestly sized black powder coated metal sign of the outline of their Greek letters on the front of the building and the addition of a landscaping uplight to illuminate the sign at night. There are no applicable standards for this change. Box 428 Mead, CO 80542 PROJECT DESCRIPTION: This is a request to change the use of an existing four-plex from multi family residential to fraternity. The property is zoned NCB — Neighborhood Conservation, Buffer District. RECOMMENDATION: Approval EXECUTIVE SUMMARY: All of the residents of the existing four-plex at 321 W. Myrtle are members of the Delta Chi Fraternity and students at Colorado State University. They request to change the use of their building from multi -family residential to a fraternity in order to hang a sign with their Greek letters on the front of the house. They will not be making any other physical changes to the building or site. A neighborhood meeting was held on January 12, 2005. One neighbor attended and did not have serious concerns.
