We, the undersigned, do hereby respectfully petition and request that the City Council
amend the zoning ordinance of the City of Fort Collins by changing the zoning of the
hereinafter described parcel, containing acres, more or less, from "T" zoning
district to "RDR" zoning district:

As a result of the condemnation action instituted by the City of Fort Collins in Case No.
95 CV 495, the Burlington Northern Railroad right-of-way was relocated. The right-of-
way area which previously had been located at the southerly boundaries of Parcels 008,
009 and 018 was vacated and conveyed to Schrader Oil Co. by the Burlington Northern
and Santa Fe Railway Company by quitclaim deed dated March 11, 1999, and recorded
at Reception No. 200032173. A new railroad easement extending from Willow Street to
Linden Street, including over portions of Lots 11, 13 and 15 in Block 6 was conveyed by
Schrader Oil Co. and Wayne K. Schrader by deed dated March 17, 1999, and recorded
at Reception No. 200032172.

under.
