Using the UCBC (Conservation Code) Section 501.1 requires a "Change of Occupancy" to conform with this code and "Where no specific requirements are included herein, the building or structure shall comply with the building code." in this case the 1997 Uniform Building Code (UBC) as adopted by the City. In the UBC Existing Buildings Section 3405, requires that no change in use shall be made to a building until the building is made to comply with the code. Changing the structure from a residence to a museum open to the public is the change of occupancy and would require the building to comply with this code (disabled access and restrooms part of that requirement) and receive a new certificate of occupancy. At this point 1 have not been presented with anything that I can use for an alternate approach to the concerns, nor do I recognize what describing the building as an "Artifact" will achieve. I can release a Demo permit after released by the State once asbestos concerns answered, so that tear -down work can begin. ditlT > Anne Aspen Tuesday, November 02, 2004 >>> Hi Carol, Any thoughts about the email I forwarded you yesterday? I'd like to get back to Rick as soon as I can since he has been in touch with the applicant (Byron)about it. I heard from Katherine Woods (also part of the applicant team) that they are worried. I'd like to allay their fears if possible. Also, I noticed on the architectural plans that there is a comment which states: "Note: This project involves the preservation and rehabilitation of a designated historic landmark structure For building code review the building may be considered an artifact."
