Shelby,
We have placed approved projects officially "on -hold" in the past and I see no reason to not do the same
thing in this situation. We have also refunded application fees in the past if there is a legitimate reason for
it. Obviously, we wouldn't want to refund the fees until he has officially withdrawn the application and
submitted a request letter to us to that effect.
My perspective is that all of these conditions need to be clearly documented in a letter from the Current
Planning Director to the applicant. A written fee waiver request shouldn't be submitted unless/until the
applicant withdraws the sub.

Cameron and Pete,
Katie received a call from Rob Haas about the subdivision process at 3000 S. Taft Hill. If you remember
he subdivided the property through a Type I hearing and has not submitted mylars yet due to a technicality
in the DA, which states that any development on the property will have to go through a PDP process. He
is going to try to sell the land with a meets and bounds description (suggested by his attorney), and if this
goes as planned, he would like to withdraw his application, and be refunded for his application fees
(suggested by Paul). However, while this property is on the market, he would like the project to be placed
on hold indefinitely so that the new owner would have the option to purchase the property with the meets
and bounds description or proceed with the final subdivision plat (and the "anti" Development Agreement).
I understand that if he would like an extension, he must submit a request in writing. However, since he is
requesting a type of hold on the project, what do we need? Do we need some sort of letter or approval
from the current planning director?
Also, should we tell him to submit a request in writing for any fee refund? Is there a process he should
follow, or is a letter sufficient?
