SUMMARY OF CONCLUSIONS A. The Haas Subdivision Project Development Plan is subject to administrative review and the requirements of the Land Use Code (LUC). B. The Haas Subdivision Project Development Plan complies with all applicable District Standard contained in Article 4 of the Land Use Code C. The Haas Subdivision Project Development Plan complies with all applicable General Development Standards, including the Plat Standards, contained in Article 3 of the Land Use Code. DECISION The Haas Subdivision Project Development Plan, #1-05, is hereby approved by the Hearing Officer without condition. Dated this 22nd day of April 2005, per authority granted by Sections 1.4.9(E) and 2.1 of the Land Use Code. Compatibility with Surrounding Uses: The surrounding zoning and land uses are as follows: N: LMN; single family residential S: LMN; single family residential E: LIE; single family residential W: LMN single-family residential The property was annexed into the City in 2003 as part of an enclave annexation referred to as the S. Taft Hill 7Ih 2. Compliance with Article 4 and the LMN Zoning District Standards: The proposed subdivision is exempt from the Density Standards defined by Section 4.4 D (1) in that the property is less than 20 acres in size and located within the "infill area". There are no other Land Use Standards applicable to the development. 3. Compliance with Article 3 of the Land Use Code — General Development Standards A. Section 3.3.1 [B] — Lots The proposed lots complies with the design standards in that the lots are provided vehicular access to a public street and the side lot lines are at substantially right angles or radial to the street. Lot 1 has existing access from S. Taft Hill Road and Lot 2 receives access to S. Taft Hill Road via a public access easement dedicated by separate instrument. Lot 3 will take access from the Haas Lane right-of-way being dedicated on the subdivision plat. B. Section 3.3.1 [C] (1) - Public Sites, Reservations, and.Dedications The plat includes dedioation of public right-of-way, and utility, drainage, irrigation, access, and emergency access easements, necessary to serve the subject property. Sixty (60) feet of right-of-way will be dedicated via the subdivision plat in order to accommodate a new road to be named Haas Lane, which will include Haas Subdivision Administrative Hearing Findings, Conclusions, and Decision April 18, 2005 Page 2 of 4 NOTICE OF PUBLIC HEARING: Evidence presented to the Hearing Officer established no controversy or facts to refute that the hearing was properly posted, legal notices mailed and notice published. The Hearing Officer, presiding pursuant to the Fort Collins Land Use Code, opened the hearing at approximately 2:00 p.m. on April 18, 2005 in Conference Room A at 281 N. College Avenue, Fort Collins, Colorado. HEARING TESTIMONY, WRITTEN COMMENTS AND OTHER EVIDENCE: The Hearing Officer accepted during the hearing the following evidence: (1) Planning Department Staff Report; (2) application, plans, maps and other supporting documents submitted by the applicant and the applicant's representatives to the City of Fort Collins; and (3) a tape recording of testimony provided during the hearing. The LUC, the City's Comprehensive Plan (City Plan), and the formally promulgated policies of the City are all considered part of the evidence considered by the Hearing Officer. Two detached single family houses, two utility sheds, and one outbuilding used for storage, are presently located on proposed Lot 1. The Pleasant Valley and Lake Canal crosses the property. The project is located at 3000 South Taft Hill Road (south of Drake Road on the east side of South Taft Hill Road).
